Your reply to my request re the Matheson Place playground is too general & vague for it to be useful to me, & therefore does not fulfil my request, as you stand. Here is your reply:
Original FOI request: Children's playgrounds
The siting of play areas would form part of the planning permission
process. The appropriate placing of a play area location in terms of noise
and proximity to houses would be factored in at the time of the
application. Please see below all the regulations operated by the Council
regarding the siting & operation of children's playgrounds.
Health and safety at Work Act 1974
Occupiers Liability (Scotland) Act 1960
Equality Act 2010
Fairer Scotland Duty
UN Convention of the rights of the child
BS EN regulations 1176/1177/17232/16630/11468/15312.
I would have to id the particular parts of all these Acts to make any headway with informing myself on this particular matter. Please copy me relevant texts from those acts.
More immediately, kindly copy me all your documentation on the establishment of the playground - from the original application through the planning process culminating in Permission with any conditions imposed by HC. Ie these will be copies of docs you have on file.

Thank you for your follow up enquiry dated 16^th July 2023 regarding the
Council’s response to your request for information relating to children’s
play parks (FS-Case-530381034).
You have asked if we can expand upon the information given relating to the
legislation provided in our response. I will contact the Service and look
into this for you. I am treating this as a request for review of the
Council’s response to your request for information under Regulation 16 of
the Environmental Information (Scotland) Regulations 2004.
In your recent correspondence, you have also asked:

There is no record of any planning application being made for this area of
land on our system.
This is because the works were considered a ‘Council’ project and the
project fell within the financial and other limitations of the General
Permitted Development Order. As such, the Order would have granted
planning permission automatically.
The Portree & Braes Community Trust were successful with an application
for funding from the Community Regeneration Fund. Further information can
be found in the attached documents as this issue was discussed at the
meeting of the Isle of Skye and Raasay Committee on the 30th January 2023.
Under Section 20 of Freedom of Information (Scotland) Act, you have the
right to request that the Highland Council reviews any aspect of how it
has dealt with your request. This requirement for review should be
requested to the Freedom of Information Officer, Chief Executive’s Office,
Glenurquhart Road, Inverness IV3 5NX, or [email address], within 40
working days of receipt of this response. The request should include
details of the information requested and the aspects of the Highland
Council’s response which you are not satisfied with.
If you are subsequently dissatisfied with the outcome of the Council's
review, you have the right to appeal to the Scottish Information
Commissioner under Section 47 of the Freedom of Information (Scotland)
Act, within six months of receiving the Council's review response.
