Children's play areas in the Edmonstone area

The request was partially successful.

Dear City of Edinburgh Council,

I would like to inquire about the three play areas that were supposed to be present in the development REF 12/01624/FUL near Gilmerton / Old Dalkeith Road / Manor Wood area. Based on the original planning permission, and the sales brochures there was supposed to be three play areas in this area, which was a big selling point of the new area.

However the builder recently confirmed that all three play areas have been revoked by the council. Since we cannot find any such note in the original planning permissions, or in any of the variations of it, and none of the inhabitants of the new development were included in any consultation that the play areas will not go ahead we would like to know who when and why has decided that the play areas are cancelled.

Yours faithfully,
Z.S.S. Raven

Dear Z.S.S. Raven

Environmental Information (Scotland) Regulations 2004 - Information not
held

Subject: Children's play areas in the Edmonstone area

Thank you for your request for information of 05/10/2020 which has been
processed in line with the terms of the Environmental Information
(Scotland) Regulations 2004. You asked the following:

I would like to inquire about the three play areas that were supposed to
be present in the development REF 12/01624/FUL near Gilmerton / Old
Dalkeith Road / Manor Wood area. Based on the original planning
permission, and the sales brochures there was supposed to be three play
areas in this area, which was a big selling point of the new area.

However the builder recently confirmed that all three play areas have been
revoked by the council. Since we cannot find any such note in the original
planning permissions, or in any of the variations of it, and none of the
inhabitants of the new development were included in any consultation that
the play areas will not go ahead we would like to know who when and why
has decided that the play areas are cancelled.

Unfortunately, we are unable to provide you with the information requested
as it is not held by the Council. The Council is therefore relying on the
exception under regulation 10(4)(a) of the EIRs.

We can find no records which show the deletion of the three play parks
which are shown on the approved plans. The Planning Officer’s opinion is
that planning permission 14/00578/FUL and non-material variation of
planning permission 14/00578/VARY supersede planning permission
12/01624/FUL referred to. Plans and documents for all the aforementioned
permissions show three play parks and can be viewed on the Planning Portal
at the following link:

Please note that this letter constitutes a formal notice under regulation
13 of the Environmental Information (Scotland) Regulations 2004.
