Dear Kent Safeguarding Children Board,

Under the FOI Act I require the amount of children defined by sex and ages taken by Kent Police using a Police Protection Order on 7th December 2012 to place the children with Kent County Council Children Services.

1. How many of these children were taken into care without Kent County Council obtaining an Emergency Protection Order.

2. How many of these children were taken into care using a Police Protection Order.

3. How many of these children were removed using a Police
Protection Order on the 7th December 2012 had either of the
following Public Servants present:
Child Protection Officer DC Fleur Hardie 10063
PC Paul Walker
and confirm that all officers have been CRB checked.

4. 'Child Act 1989' police protection powers states 7. The child is considered to be in police protection when these powers have been exercised by the police. This is not an order granted by a court so therefore should not be referred to as a police protection order.
What is name of the Custody Officer on duty on the 7th December 2012 at Gravesend Police Station.
Who was the Initiating Officer and the Designated Officer on duty on the 7th December 2012.

5. How many families initiated criminal charges against Kent Police Officers on the 8th December 2012 after having their children removed on the 7th December 2012..

6. On how many occasions including the 8th December 2012 has
Inspector Innes 8556 refused to file criminal charges against individual police officers and refused to issue a crime number.

7. On how many occasions including the 8th December 2012 has
Inspector Innes 8556 refused to file a criminal charge of:
Unlawful Trespass,
Unlawful Search,
Unlawful Kidnap,
Unlawful Arrest
and instead referred to it as a police complaint

Thank you for your request for information. Kent County Council's response
is as follows:
 

With regards to Question 1 and 2: Ten children came into the Care of Kent
County Council on the 7th December 2012.  Any further breakdown of this
information, e.g. by Legal Order, Gender or Age could potentially identify
the individuals involved (because the figures may be less than five) and
would therefore constitute a breach of the Data Protection Act 1998.
Therefore, this information is exempt from disclosure under section 40 of
the Freedom of Information Act 2000 on the grounds that it is personal
information. 

 

With regards to Questions 3-7: KCC does not hold this information. We
suggest that you contact the Police directly for this information. I have
