To this end, I would appreciate answers to the following enquiries:

1. Please can you share any policies, procedures, guidelines, or related documents pertaining to Child Safeguarding that were in effect between January 2015 and December 2018?

2. Please may I have a record of the number of safeguarding referrals made concerning staff of the neonatal unit from January 2015 through December 2018?

3. Please can you confirm how many referrals the trust made to the Disclosure and Barring Service between January 2015 and December 2018, specifically regarding concerns that staff might pose a threat to children, in accordance with the Safeguarding Vulnerable Groups Act 2006?

I am writing to request an internal review of Countess of Chester Hospital NHS Foundation Trust's handling of my FOI request 'Child Safeguarding Policies and Referral Records (2015-2018) at Countess of Chester Hospital NHS Foundation Trust'.

Points for Review:

Timeliness of Response: The response was significantly delayed without any explanation or apology for the delay. The Freedom of Information Act 2000 mandates a response within 20 working days, and this was not adhered to.

Exemption on Referrals to the DBS: The Trust's reliance on section 40(2) and (3A) of the Freedom of Information Act 2000, citing personal data concerns, seems misplaced. The request was for a numerical figure of referrals, not individual details. Furthermore, it has been publicly confirmed that a search was conducted on 22nd August 2023 by the Disclosure and Barring Service for cases referred by the Countess of Chester Hospital NHS Foundation Trust to DBS between 1st January 2015 to 31st December 2018, and no referrals were found. Exemption under Section 32: The Trust's reliance on section 32 of the Freedom of Information Act 2000, stating that some information is held 'only by virtue' of being contained in documents for criminal court or inquiry processes, is ambiguous. Clarification is needed on which specific parts of the request this pertains to and why this exemption is relevant.

In relation to the request for child protection policies and procedures, I would like to highlight that the Countess of Chester Hospital NHS Foundation Trust has a statutory obligation to provide such information. This obligation is enshrined in several pieces of legislation, including the Children Act 1989, Children Act 2004, Childcare Act 2006, Crime and Disorder Act 1998, and the Housing Act 1996. Furthermore, the "Working Together to Safeguard Children 2018" statutory guidance explicitly details the responsibilities and expectations of organisations in ensuring the welfare and safety of children. Denying access to these policies and procedures not only contravenes the spirit of the Freedom of Information Act but also undermines the transparency and accountability mechanisms set out in the aforementioned statutes and guidance.

I have formally referred the Countess of Chester Hospital NHS Foundation Trust to the Information Commissioner's Office (ICO) for an independent review of their response and internal review concerning the Freedom of Information Act (FOIA) 2000 request. This action follows the Trust's significant delays and what is perceived as inappropriate application of FOIA exemptions in handling the request for information on child safeguarding policies and referral records from 2015 to 2018. I am writing to request an update on my Freedom of Information (FOI)
