I refer to the recent Child Protection failings in Haringey that are referred to the judgement of 13th March 2013. Please see the links to the High Court case reports that have been placed in the public domain by Judge Thornton because it is in the public interest to do so.

Please disclose all the correspondence, reports and communications.

If yes please disclose all the documents, letters, reports, statistical information, and other informations that was under consideration when Haringey Council made its decision whether or not to carry out an independent investigation.

If Haringey Council is commissioning an independent investigation, then provide the terms of reference report for that investigation and any documents to be considered with the terms of reference report.

My correspondence with OFSTED indicates the following:

Local authority managers are normally asked whether there are any issues that the inspectors should be aware of, that may be relevant to an inspection.

It is then up to the managers within the local authority to determine whether or not there is relevant information to be shared.

When an unannounced inspection was carried out at Haringey CYPS in October 2011, inspectors were *not* made aware of the (then live) AB-CD legal case.

(and nor was the AB-CD case one of those that were randomly selected from the hundreds of open and closed cases available for selection).

In respect of this case, the Claim for Judicial Review was filed in August 2011 (two months before the inspection) and in March 2012, a Judge agreed at the Permissions Hearing that the case could proceed to a full Judicial Review.

Eventually (March 2013) the case was decided in favour of the Claimant, with award of all costs plus *damages*. This is without precedent.

We have received correspondence from individual members of the public. We
would not necessarily be able to release this correspondence to FOI
requesters as it may contain personal data and/or be subject to a duty of
confidentiality. We have assumed that you are interested in formal
communications between the Council, our partner organisations and central
government and regulatory bodies regarding the judgment. I have attached
the following documents:

We have also sought and obtained legal advice. We cannot disclose the
communications between the Council and its legal advisers, or the legal
advice given, as they are subject to legal professional privilege. They
are therefore exempt from the Freedom of Information Act under Section 42
of that Act. When relying on this exemption, we must consider the public
interest. It is accepted that in cases involving legal professional
privilege, there must be a strong public interest in disclosure to offset
the strong public interest in safeguarding openness in communications
between lawyers and their clients to ensure full and frank legal advice.
We do not think that the public interest in disclosure is sufficiently
strong in this case. This letter is a Refusal Notice as required under the
Freedom of Information Act.

I am writing to request an internal review of Haringey Borough Council's handling of my FOI request 'Child Protection failings and lessons learnt'.

Please note that I requested all correspondence, reports, communications, and documents. You claim an exemption of legal privilege to obfuscate any reasons you have for witholding the information I requested. To be absolutely clear I have not requested any legally privileged information, i.e. that which passed between you and your legal advisors.

To be quite clear I am requesting the information which passed between managers, e.g. communications between the Chief Executive and the Director of Children's Services, as well as other communications between managers, communications between managers and staff, and communications between officers of the council and elected councillors. I am also requesting all the documents and reports that were under consideration.
