Thank you for your request for Information, received at this office on 30 September, 2013, in which you requested details of the following:

Request for information regarding Police & Staff with this force convicted of child and sexual offences

Your request will now be considered and you will receive a response within the statutory timescale of 20 working days as defined by the Act, subject to the information not being exempt or containing a reference to a third party. In some circumstances Humberside Police may be unable to achieve this deadline. If this is likely you will be informed and given a revised time-scale at the earliest opportunity.

There may be a fee payable for the retrieval, collation and provision of the information you request. If this is the case you will be informed and the 20 working day timescale will be suspended until we receive payment from you. If you chose not to make a payment then your request will remain unanswered.

Some requests may also require either full or partial transference to another public authority in order to answer your query in the fullest possible way. Again, you will be informed if this is the case.

Could you state whether each is staff or police officer
Please could you give the dates of the offences
Please could you give the dates of conviction for the 4 individuals
Please could you give the dates they resigned or were sacked and the actual dates that they left.
Please could you give any internal disciplinary measures the police took with regard to these individuals.
Please give the exact offences committed.
Please could you give the rank when they left the police
Please could you confirm that they are receiving their full pension entitlement
Please could you state what offences come under the heading child and sexual offences?
Could you just explain what you meant about not comparing the figures with any other force?

1 To use section 21 exemption means you have to have the information. Therefore is the force, under full liability stating that all in the newspaper reports are true as regards the questions I asked?
2 Which information do you hold?
3 There appear some parts of the questions unanswered eg what offences come under child and sexual offences?
Exact offences committed, exact dates of conviction, resignation etc etc
4 Is A PCSO counted as police or support?

Please can I have a full answer to all my questions and clear indication of the exemptions and the reasons

Dear Ms Fox.

No s21 does not mean we have to hold all the information to apply the exemption, only that we know it is held somewhere else i.e. information in the public domain on our website etc and we can direct the applicant to it. As pointed out we do not hold all the information but some was reasonably accessible (press articles covering the court proceedings) in the public domain. You will see this also shows who the officers/staff where. The news articles adequately covered some of the information sought.

However I will address your points below:

PCSO : Date of offence: No information held, Conviction date: 15.06.12 Resigned 29.01.12
Police Staff Member: Date of offence: 01.12.2008, Conviction date: as previously explained we do not hold the conviction date Resigned 17.02.13
Police Constable: Date of offence: only hold records showing 2004/2005 Conviction date 02.5.2008 Resignation date 6.6.2008

Police note our Professional Standards department does not always record the conviction date as in most cases the me member of staff resigns prior to any pending court proceedings.

4). A PCSO is classed as civilian employee.

Dear Humberside Police,

I am writing to request an internal review of Humberside Police's handling of my FOI request 'Child abuse offences by Humberside Police'.

1. James Green stated this:
"I trust this now concludes your request on this subject area. Any further information sought in relation to this area will not be answered for 60 days as it would be classed as a repeat request."

Under what section of the law or guidance does this statement derive?
Further it comes across to be a threat to warn off any further correspondence on this subject no matter what it may be, and legitimate questions were being asked. It is not believed that this statement as written is correct in law.

2.Under ICO guidance Information reasonably accessible to the applicant by other means (Section 21) it states Section 9- "It is important to emphasise that a public authoirty must know that it holds the information in order to be able to apply the section 21 exemption."

James would therefore appear incorrect in his statement
