Firstly, can I offer my sincere apologies for the oversight in not
responding to your original request; this was an administrative error for
which I am responsible for.

 

I wish to advise you that there is no record of a formal response provided
by the Council or Children’s Services following the Duffy Inquiry and
Operation Goldfinch 1997/8.

 

If you are dissatisfied with this response, we would inform you that the
Authority has in place a FOI appeals procedure.  Appeals should be
forwarded in writing to the Authority's Monitoring Officer, setting out
you reasons why you consider that the response is erroneous.  The address
of the Monitoring Officer is Head of Legal & Democratic Services, Civic
Centre, Port Talbot, SA13 1PJ

 

In the event that you appeal to the Monitoring Officer and are
dissatisfied with the response to your appeal, we would also inform you
that you are entitled to appeal directly to the Information Commissioner. 
However please note that the Information Commissioner normally requires
appeals to have gone through the relevant public authority's appeal's
procedure before he will deal with them.  The Information Commissioner's
address is: Information Commissioner's Office, Wycliffe House, Water
Lane, Wilmslow, Cheshire, SK9 5AF.

Dear Leighton Jones,

Thank you for being honest and taking responsibility. It is the first time someone has done so in my FOI requests.
However I believe there must have been some response surely otherwise the Council would be open to claims of negligence.
Is there nothing in the minutes of the Social Services Committee or similar ?
Is there any record that any committee discussed the report?

Dear Ms Hemsley,

 

I can confirm that in responding to your original request I researched the
Council’s committee reports, without success; I can confirm I approached
the Secretariat of the Director and the Head of Children’s Services, again
no record was found. This enabled me to arrive at the conclusion there is
no record.

 

As I believe it was a Police lead enquiry/investigation, there may be
merit in approaching them for any information they hold? I assume you have
done so.

 

If I can provide any further information please do not hesitate to contact
me.

Dear Leighton Jones,
Thank you for your reply. Yes it was a police led inquiry. What i wanted was the councils response to it, therefore it is best to approach the council rather than the police.
I hope you understand that i find it very odd that after sexual abuse is found at residential homes that there is no council response.
