Chief executives diary of 7th October 2014

The request was partially successful.

Dear Wirral Metropolitan Borough Council

I believe that the chief Executives engagements are and were listed on outlook within Exchange Server and that the back-up procedures of the council are sufficient to recall the diary for the 7th October 2014.

I request to be apprised of Mr burgess's diary for that day.

A meeting of the Audit and risk committee was cancelled on that day , albeit it had been fixed three months before at an abortive meeting in July. The public attendees at the july meeting were left with no meeting after it broke up within half an hour; subsequently having diarised the 7th October potential attendees were disappointed by the former chief executive cancelling the meeting at 6:15 pm on the grounfs he had an important meeting to attend.

The press were wrong footed by this as were many potential attendees.

Therefore I wish to see what important meeting alternatively Mr Burgess was to attend on the 7th October and indeed confirm that he did attend such a meeting

Dear Mr. Hobro,

Thank you for your request for information shown below. 

 

The meeting that Mr. Burgess was to attend on 7th October 2014 was a
Combined Authority Meeting to be held in Wakefield and it was scheduled to
last all day.   Mr. Burgess did not attend the meeting as he was 
unavailable for work on that day.   The Council will not be disclosing the
reason for Mr. Burgess  not attending the meeting in question and in
refusing the Council is relying on the exemption contained within section
40 (2) of The Freedom of Information Act 2000.

 

I consider that the information requested is exempt information in that
you are asking for information which is personal data, in respect of which
you are not the data subject.  Disclosing the requested information would
contravene the first data protection principle, that personal data shall
be processed fairly and lawfully and shall not be processed unless at
least one of the conditions in Schedule 2 of the Data Protection Act 1998
is met. 

 

I do not consider that any of the conditions in Schedule 2 would be met
and particularly Condition 6 of Schedule 2 in that the processing would be
unwarranted by reason of prejudice to the rights and freedoms or
legitimate interests of the data subject.  I do not consider that such
processing would be necessary for the purposes of legitimate interests
pursued by you, as a third party, being a member of the public.

 

I have considered whether there is a legitimate public interest in
disclosing the requested information and I have balanced this against the
rights of the data subject.  I consider that disclosure of the information
requested would cause an unwarranted interference with the rights of the
data subject, which outweighs any legitimate interests pursued by you as a
third party.   I believe as explained above that the first data protection
principle would be breached if the withheld information was disclosed.

Most interesting that after an absence of one day neither attending this meeting in wakefield nor The Audit and Risk committee he then should annunce his retirement with no pay off two days later and his Head of engagement should thenm find herself in hospital one month and a half later.

A strange concatenation of events indeed.

I quote yourselves and having checked this alibi on the west Yorkshire website I find that there was no scheduled meeting of the Combined authorty diarised nor minuted. As you are aware meetings of public authorities must be minuted and made public.
Unless you provided evidence within two days of this meeting, and indeed the unlikely proposition that Mr Burgess would be invited to attend the same, I will appeal to the information commissioner

Thank you for your email below.  I have reviewed the handling of your

Council's response contained the following text "...  The meeting that Mr.
Burgess was to attend on 7th October 2014 was a  Combined Authority
Meeting to be held in Wakefield and it was scheduled to last all day.  
Mr. Burgess did not attend the meeting as he was unavailable for work on
that day.   The Council will not be disclosing the reason for Mr. Burgess
not attending the meeting in question and in refusing the Council is

of Information Act 2000...."

 

The reviewer can confirm that the recorded information held within Mr.
Burgess's diary for 7th October 2014 was indeed the information which was
given to you, i.e. a Combined Authority Meeting to be held in Wakefield.

Well if that was what was in his diary you are acquitted of your duties under FOI as it is the only record that you have.

However it does raise questions as to the former Chief Executive's integrity despite the protestations of the "Most Improved Council made by him and by the Corporation.

There was no meeting in Wakefield and Mr Burgess could not have attended it, nor had it seems any intention so to do. Rather he phoned or emailed in sick thus causing pandemonium as regards the Special Meeting of the Audit and Risk Committee that had been scheduled for that day.

He clearly emailed Councillors, forgetting Cllr Kelly, that he had a meeting that clashed with this Audit and Risk committee that had been scheduled months beforehand.

A strange concatenation that after the meeting on the 8th October he RESIGNED.!!!!

Nigel, although Graham Burgess leaving Wirral Council was made public after the special meeting, I will point out (this is an educated guess as there are standard HR clauses common to Wirral Council employees) that his terms and conditions of employment (no doubt Wirral Council would bat off a FOI request for that stating that it's personal data) would've required 3 months notice.

His last day of employment was (if memory serves correct) the 31st December later that year, therefore he would've communicated his intention to leave (presumably as a Chief Exec has no line manager this was done to HR and the politicians) prior to the special meeting of the Audit and Risk Management Committee on the 8th October.

I hope that clarifies matters without Wirral Council moaning and groaning about having to respond to another FOI request. :D

In other words I'm telling you that he had made a decision to leave before the Audit and Risk Management Committee met on the 8th October.

You, at least, have done better than I with my diary request to Merseyside PCC....refused 'as diaries are deleted after
6 weeks unless retained for a purpose'
