With regard to your Freedom of Information application we can now confirm
that we are in receipt of all the relevant information.
The Freedom of Information Act obliges us to respond to requests promptly
and in any case no later than 20 working after receiving your request. We
must consider firstly whether we can comply with S1(1)(a) of the Act,
which is our duty to confirm whether or not the information requested is
held and secondly we must comply with s1(1)(b), which is the provision of
such information. However, when a qualified exemption applies either to
the confirmation or denial or the information provision and the public
interest test is engaged, the Act allows the time for response to be
longer than 20 days, if the balance of such public interest is
undetermined.
In this case we have not yet reached a decision on where the balance of
the public interest test lies, in respect of either of these obligations.
We estimate that it will take an additional 20 working days to take a
decision on where this balance lies. Therefore, we plan to let you have a
response by the 14/10/2013.
The specific exemption which applies in relation to your request is
Section 30(1) (a) Investigations and proceedings conducted by public
authorities, which is a qualified and class based exemption and requires
that a public interest test is applied surrounding the release of
information held by North Wales Police.
Even though it is our intention to carry out a public interest test and
update you with the resulting decision, as the initial 20 days has been
exceeded there is a further requirement to provide a refusal notice
covering this time period. Therefore, in accordance with the Freedom of
Information Act 2000, this letter acts as a Refusal Notice under section
17 (2)(b) of the legislation.

I am writing to request an internal review of North Wales Police's handling of my FOI request 'Ched Evans - emails'.
I have been sent some email, but not others & know I get a reply saying it's too expensive ! I can't understand the phrase that 'the system is set up for policing , surely because of that you can retrieve emails cost effectively ?
In addition to conducting an internal review, can you also draw this matter to the attention of Winstone Roddick QC as I believe there has been a deliberate attempt to mislead.
Can you confirm in writing via this system that you have drawn this matter to the police commissioners attention ?
