I would suggest you consider the response carefully and see:
Appendix A applied in Areas 6, 8 & 9 – where the service provider is Kier Highways Ltd. http://www.englandhighways.co.uk/are-hig...

It appears Highways England’s audits of their contractor are lacking; they have failed to identify (for example) that in Area 9 Kier Highways Ltd do not comply with the contract in respect of charging Third Parties. Even following our concerns, raised in 10/2015, the conduct was either not identified or allowed to continue.

However, audits have historically been supplied by Eighways England without any (known) adverse effect to the commercial interests of a contractor. It appears Highways England prefer to withhold as they commonly cite ‘commercially interests’, not held or vexatious.

It should also be noted that Kier Highways , following allegations of systematic exaggeration of claims and failure to comply with the contract, were apparently being audited by KPMG. This was to have commenced in or about 11/2017 and was anticipated to be concluded in 01/2018.
