I would like to make a freedom of information request for full and complete copies of all the Channel 4 communications with Ofcom relating to the Ofcom consultation 'Content management on the HD Freeview platform' (Start date: 22 January 2010, End date: 02 April 2010).

Could you also send me copies of any communications Channel 4 had throughout 2009 with Ofcom, other broadcasters and rights holders relating to this matter.

Additionally could you provide me with the dates, venues and records of the discussions at face to face meetings, relating to this same matter, that Channel 4 had with representatives from Ofcom, the BBC, Channel 4 and rightsholders between September 2009 and December 2009.

are still consulting with relevant third parties regarding the requested

Thank you for your request for information made under the Freedom of
Information Act 2000 ("the Act"), which we received on 5^th July 2011. In
your request, you asked for information regarding Ofcom's consultation on
`Content Management on the HD Freeview Platform' in 2010. Specifically,
you requested:

1. Full and complete copies of all Channel 4 communications with Ofcom
relating to this consultation;
2. Copies of any communications Channel 4 had throughout 2009 with Ofcom,
other broadcasters and rightsholders relating to this matter;

A. Channel 4 communications with Ofcom

As regards this part of your request, we enclose the following:

As you may be aware, Channel 4's additional response to the consultation
was published on Ofcom's website in a redacted form. We have not disclosed
a full version of that document with this response because we consider
that the redacted information is exempt from disclosure pursuant to
section 43(2) of the Act. The withheld information refers to details about
Channel 4's confidential negotiated terms with content providers in
relation to broadcast rights and restrictions on content. In applying
section 43 of the Act, we are required to consider the public interest
test. We do not consider it would be in the public interest to prejudice
Channel 4's commercial interests by revealing details of the confidential
terms that have been negotiated with our content providers.

Please note that all personal data, including names, email addresses and
phone numbers has been redacted from the attached emails pursuant to
section 40 of the Act (personal data). We have, however, indicated which
organisations were copied in the correspondence.

B. Channel 4 communications with Ofcom, other broadcasters and
rightsholders during 2009

As regards this part of your request, we enclose the following:

1. Emails from the BBC dated 16, 17 and 19 June 2009 with attached
presentation entitled `Proposed Changes to HD Content Management for
DVB-T2' (dated 19^th June 2009);
2. Email from the BBC dated 22 June 2009 with attached presentation
entitled `Proposed Changes to HD Content Management for DVB-T2' (dated
22^nd June 2009);
3. Email from the BBC dated 30 July 2009 with attached Draft DTLA
Encoding Rules;
4. Email from the BBC dated 28 September 2009;
5. Email from the BBC dated 30 October 2009 with attached Draft DTLA
Encoding Rules, DTLA IP Statement (dated 10 July 2001) and
presentation entitled `Content Management for Freeview HD' (dated
30^th October 2009);
6. Email from ITV dated 24 November 2009;
7. Email from the BBC dated 21 December 2009 with attached BBC submission
in response to Ofcom's letter of 9 November 2009;
8. Email from the BBC dated 23 December 2009 with attached final BBC
submission in response to Ofcom's letter of 9 November 2009.

As regards the BBC presentations attached to emails B1 and B2, please note
that since the date of these presentations, EBU members have now reached
agreement on a common approach to Content Management which allows for both
the BBC and other EBU members to adopt solutions in accordance with local
practices.

Please also note that all personal data, including names, email addresses
and phone numbers has been redacted from these emails pursuant to section
40 of the Act (personal data). We have, however, indicated which
organisations were copied in the correspondence.

C. Details of any meetings regarding this matter during September to
December 2009

As regards the final part of your request, details of any meetings
regarding this matter are referred to in the email correspondence
disclosed in Part 2 of this response. However, for ease of reference, we
have listed details of the meetings below. Please note that we do not hold
any separate records of the discussions at these meetings:

o A meeting was held at the BBC's offices on 30 October 2009 which was
attended by representatives from the BBC, Channel 4, ITV and Five.

o Whilst not covered by the scope of your request, we understand that a
meeting was held at Freeview's offices on 18 March 2010 which was
attended by content providers as well as the broadcasters and Ofcom.
