Changing gender on a driving licence

Dear Driver and Vehicle Licensing Agency,

I refer to the guidance on your website.

"If you’ve changed your gender, send DVLA one of the following:
a deed poll
a statutory declaration
your gender recognition certificate "

I understand that a gender recognition certificate is proof of change of gender in accordance with the Gender Recognition Act 2004. However, the Act does not specify that a deed poll or statutory declaration is sufficient to change gender for official purposes. The Driver and Vehicle Licensing Agency is acting outwith the provisions of the Act in this regard.

When was this policy of going beyond the provisions of the Act adopted?

Who made the decision? If it was taken at a political decision, please supply the name of the individual responsible. If it was taken by officials, please supply the name and Civil Service grades of the individual/individuals responsible. If there is a policy of not naming civil servants, please supply the grades of the individual/individuals.

What consultation was there about this change? Please supply the consultation document and the responses to it.

Was an equality impact assessment undertaken? If so, please supply it.

What discussion was there with the police and safeguarding bodies about the danger of a man using a driving licence issued under this policy to pass himself off as a woman and enter women-only spaces or to access children and vulnerable adults? Please supply the relevant documentation.

Further to the question above what discussion was there about the legal liability of the DVLA in such a case? Please supply the documentation.

Please state what procedures the DVLA undertakes to make sure that an individual does not take advantage of this policy to obtain two driving licences one showing him/her as male and one as female.
