Changes to the Constitution of LCRCA

Dear Halton, Knowsley, Liverpool, St Helens, Sefton and Wirral Combined Authority,
Could you please supply the following information:
[1] What changes were made to the constitution of LCRCA that permitted LCRCA to use circa 6.8 million of the annual Gain Share Fund for a whole range of new officers

[2] Please supply all docs that indicate who gave Ged Fitzgerald permission to oversee these new staffing arrangements?

[3] Please supply all docs/information that indicate why this was done a year before a Metro Mayor has even been elected?

I am in receipt of your requests pursuant to the Freedom of Information legislation and respond as follows ;

1. No changes to the existing Constitution were required .The power being exercised is enshrined within the current Constitution and in statute as explained at point 2 below.

2.The existing Constitution of the Combined Authority , which is publicly available , places a duty upon the Combined Authority to appoint a Head of Paid Service. The Constitution of the Combined Authority also states that the Head of Paid Service will have the functions of a Head of Paid Service as set out in the Local Government and Housing Act 1989. Those statutory duties include the duty to set out the manner in which the Authority shall discharge its functions and the number and grade of staff required for discharge of the functions. Mr Fitzgerald is the current Head of Paid Service to the Combined Authority. In presenting the report on Executive Capacity , Mr Fitzgerald was fulfilling his statutory duty.

3.As the Report makes clear , it is current capacity arrangements for work which is required to be undertaken immediately and going forward by the Combined Authority which is being addressed.
