I am interested in all changes to the lands that fall within the scope of the Aldershot and District Military Lands Byelaws (1976 - as amended) and listed below.

The areas listed below have seen their "Managed Access" boundaries removed from OS maps.

In all instances the local name is given first, then the military training area designation, and finally the OS grid ref:

I am therefore requesting copies of all communications - including emails - between Ordnance Survey and Defence Infrastructure Organisation and/or Ministry of Defence dealing with all changes to the lands within scope of the Aldershot Military Byelaws and specifically all information relating to the above areas, between Jan 1st 2020 and 22nd July 2021.

We are aware via a separate FOI of email communication between DIO and Ordnance Survey where DIO staff have requested changes and OS staff have responded.

On that basis we do not believe the search for information has been as diligent and exhaustive as the law requires and would be grateful if such a search can be executed.

Internal Review

I have now completed my internal review of our 5 August 2021 response to
this FOI request.

DECISION: REVERSED

Upon investigation, I have found an email communication between OS and the
Defence Infrastructure Organisation (DIO).

I have attached a copy of the contents of the relevant part of this email
communication, containing more specifically the following:

 8. Email dated 19 February 2020 at 08:51

I have attached the zipped mapping data files (MoD_Managed_Access.zip)
which were attached to the email of 2 March 2020 (referred to at number 1
above). In addition, I have also attached the zipped mapping data files
(‘danger_areas.zip’) referred to in the email of 19 February 2020 (number
7 above), titled ‘Range Infrastructure Technical Defence Organisation
Danger Areas'.

Based on further internal discussion, I'd like to provide a brief
explanatory note. The data we sent you on 20 April 2021 under FOI
reference FOI21997 depicted three areas marked as “DELETED FROM OS MAPS”. 
I'd like to clarify that this comment was added by Ordnance Survey; as
these three areas were not included within the Range Infrastructure
Technical Team Defence Infrastructure Organisation Danger Areas data sent
to us by DIO on 19 February 2020, we marked them for deletion within our
internal mapping intelligence database, and they were subsequently removed
from our OS 1:25,000 and 1:50,000 scale mapping products.

For clarity, the attached zipped files (MoD_Managed_Access.zip), plus
(danger_areas.zip), referred to above, are the Range Infrastructure
Technical Team Defence Infrastructure Organisation Danger Areas and
Managed Access datasets sent to us by the DIO in February and March 2020.

 

Exempt Information

Whilst we are able to release the relevant emails, note that we have
redacted the names, telephone numbers and email addresses of specific
individuals, which we consider to be exempt under section 40(2) ‘Personal
Information’ as it constitutes personal data. This includes some
third-party personal information. 

Section 40(2) provides that personal data is exempt information if one of
the conditions set out in section 40(3) is satisfied. In our view,
disclosure of this information would breach the data protection principles
contained in the General Data Protection Regulations (GDPR) and the Data
Protection Act (DPA) 2018.

 

In reaching this decision, we have particularly considered:

 

o the reasonable expectations of the individuals given their position;
Ordnance Survey considered that none of the individuals would have a
reasonable expectation that their personal data would be disclosed;
o the consequences of disclosure; and
o any legitimate public interest in disclosure.

 

Section 40(2) is an absolute exemption and therefore not subject to the
public interest test.

If, following the outcome of the Internal Review you remain unhappy with
our response, you may raise an appeal, within three months of receiving
our response, with the Information Commissioner’s Office.
