Changes to HBC Constitution - when were they approved by Cabinet / Full Council?

Dear Hastings Borough Council,

The HBC website shows part 8 of the constitution dated 23 April 2023. www.hastings.gov.uk/content/my_council/d...

Changes to the constitution require approval at Cabinet and full council. I have checked the Cabinet and Full Council minutes and the last Cabinet/Full Council approved changes were back in December 2020. This only affected parts 4 and 5.

In October 2019 parts 1, 2, 4, 6, 8 and 9 of the Constitution were approved by Cabinet and Full council.

There are no records of further amendments having been approved for part 8 since October 2019.

There are substantial difference between the version approved in October 2019 and the latest version dated 23/04/2023 available online www.hastings.gov.uk/content/my_council/d...

Can you please
1. Confirm that the 23/04/2023 version displayed online is the current version of part 8 of the constitution.
2. Provide me with copies of the Cabinet minutes and Full Council minutes that show that the substantial changes to the constitution since October 2019 have been approved by Cabinet and Full council

Dear Information Officer,

Thank you for your reply. You state that the leader and chair of WAG were consulted and agreed.

"The changes were necessary to reflect the new Senior Management Structure and the delegated responsibilities each of these post would need to statutorily look after.
The Leader and Chair of WAG were consulted and agreed to this. These are not considered substantive changes to the constitution. This was only a reallocation of already existing responsibilities to the new Senior management posts."

Could you please supply the following:

1. Copies of all documents in any format (including emails,memos, letters) etc between HBC and the leader concerning these changes.

2. Copies of all documents in any format (including emails,memos, letters) etc between HBC and the chair of WAG concerning these changes.

Dear Information Officer,

Thank you for the information.

The email trails provided are heavily redacted and make it impossible to see which party is sending the email and to whom the email is sent. This renders the unredacted information difficult and in some cases impossible to understand in context.

I don't believe this level of redaction is necessary to comply with Section 40 (2) of the Freedom of Information Act: Personal data. See ICO guidance on employee personal data: https://ico.org.uk/media/for-organisatio...

Surely the names and email addresses of elected Councillors are public domain? Surely the names and email address of officers are also public domain? These are not personal data. as defined in section 40(2).

Please provide versions that at least show the job title of the sending and receiving parties. e.g Leader of council to Legal, Planning to legal etc.

You have supplied a change control marked version of part 8 of the constitution.
The email trail provided states that parts 2,3,45,7 and 9 have also changed please supply change control marked versions of these and any other parts of the constitution that have changed.

I refer to your email dated 13 July 2023.

On reflection, as many of the names within the requested information are already in the public domain the information should have not been redacted to the extent it was.

Please find attached another copy of the requested information with some redactions of those officers not in the public domain and do fall under Section 40(2).

In respect of the constitution, the email chain shows these parts were updated to reflect new job titles and amend reference to ‘his/her’ to ‘their’. These documents were not attached to the original email chain between officers and councillors therefore was not included within our response.
