Chancellor Park adoption agreements

With reference to your response to me that most of the roads in the Chancellor Park estate did not have completed adoption agreements, could you please tell me:

1.Exactly what is meant by "the developer did not complete the adoption agreement" - what remained to be done?

2. Why these roads were allowed to be built without an adoption agreement in place?

3. Which roads did have a valid adoption agreement in place?

I am writing to request an internal review of Essex County Council's handling of my FOI request 'Chancellor Park adoption agreements'.

Following my complaint to the ICO that this request was ignored, I have received a copy of a letter you sent to them.

With regard to the question
Exactly what is meant by "the developer did not complete the adoption agreement" - what remained to be done?
you answer
The staff that originally dealt with this development no longer work for ECC or Essex Highways. The statement means that the developer did not complete an adoption agreement under section 38 of the Highways Act 1980. I cannot state why this did not take place due to staff changes and it does not indicate on our spreadsheets but it was common at this time due to the sheer amount of building works and a lack of staff resource within the industry to put the supporting paperwork in place.

I do not think this is a satisfactory answer.

1. Until very recently Robert Cilvert, who led this project, was still employed in the Highways Department. Unless he has now left, this answer is inaccurate.
2. If you are blaming the inability to explain why this happened on staff having left, this suggests that correct procedures were not followed. Could you please clarify if this is the case.
3. You do not give an answer to the question, you repeat the question. What does "completing" entail? Should the developer have drawn up the agreement or did ECC draw up an agreement which required input from the developer? If so, what input?

With regard to the question Why these roads were allowed to be built without an adoption agreement in place?

Unable to fully answer this question as the staff that originally dealt with this development no longer work for Essex County Council or Ringway Jacobs, however with all new developments this is something that is not permitted.

Again, I do not think it is correct that all staff have now left.

With regard to the following:
With reference to the other roads within the Chancellor Park, as the files have been archived we are unable to advise if they were adopted by way of Section 228 notice or by Section 38 agreement. I can confirm that this estate is now complete from our point of view and the only outstanding matter is a Traffic Regulation Order which we are progressing.

I have been refused this and another piece of information on the basis that it is archived. Surely archived information is still accessible? If not, it may as well be destroyed as archived.
