Petty, Roger, HM Land Registry

Dear Tom Burnett

Thank you for your email of 28 January 2015 where you requested
information about Chancel Repair Liability (CRL) in Staffordshire.

I am writing to advise you that following a search of our paper and
electronic records, I have established that Land Registry does not hold
the information you requested.

S.16 of the freedom of Information Act 2000 carries a duty to provide
advice and assistance.

We do not hold any information about the money raised, requested or
demanded. The only information we hold relates to entries that are put
onto the register. Since we started recording centrally in December 2012,
six parochial church councils in Staffordshire that have registered either
a caution or unilateral notices relating to chancel repair liability. They
are:

St Giles, Whittington

St Chad's, Pattingham

St Chads Church, Prees

St Bartholomews Church, Tong Albrighton

St John the Baptist, Croxhall

Holy Trinity, Lichfield

This doesn't actually answer your first question, as we are unable to say
what parishes may have the benefit of chancel repair liability - just
because some PCCs may have chosen not to register their interest it does
not necessarily mean that the right does not exist. An unregistered
interest in CRL continues to affect the land indefinitely or until such
time the land is sold for market value when the interest may fall.

The National Archives website provides a [1]guide on what information they
can provide which may assist with questions 1, 2 and 3.

If you have any queries about this letter, please contact me.

If you are dissatisfied with this response to your request, you may seek
an internal review within two months of the date of our reply. Internal
reviews will be dealt within 20 working days. If at the end of this time
we are unable to respond, we will write to you explaining the reasons and
giving you a new date. If you seek an internal review please write to:

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner (ICO) within
two months of the reply for a decision. Generally, the ICO cannot make a
decision unless you have exhausted the complaints procedure provided by
Land Registry. The Information Commissioner can be contacted at: The
Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow,
Cheshire SK9 5AF.
