Challenged procurements

The request was successful.

Dear Shetland Islands Council,

Please provide a list of all procurements which have been challenged by unsuccessful bidders since 1st January 2016. In each case please state the title of the procurement and the name of the challenging company.

Yours faithfully,

Steve Hall

Shetland Islands Council

Mr Hall

We acknowledge receipt of your request for information.

Due to the Coronavirus pandemic, a number of temporary amendments to FOI law in Scotland have been made. These amendments mean that, for a temporary period, the maximum timescale within which Scottish public authorities must respond to requests and reviews may be extended from 20 to 60 working days.

However, whilst the Shetland Islands Council is prioritising resources to support vulnerable citizens and essential services, we remain committed to providing responses to FOI requests as soon as we can. We will keep you updated with the progress of your request.

If you have any queries, or wish to check on progress with your request at any time, please contact me.

Thank you for your foi, I can confirm no procurement procedures undertaken since 1 January 2016 have resulted in formal legal action being taken against the Council.

If you are dissatisfied with the way in which the Council has dealt with your request for information on this occasion, then you may ask the authority to review its actions and decisions in relation to your request, by submitting a formal appeal to the Executive Manager - Governance and Law. A leaflet explaining this process is attached.

Dear Shetland Islands Council,

Thank you.

However, your response seems quite carefully worded. This might be a consequence of the way I worded the question - my apologies.

Please treat the following as a follow-up question: have there been any procurements since 1st January 2016 where an unsuccessful bidder has threatened legal action? If so, please state the title of the procurement and the name of the challenging company

Yours faithfully,

Steve Hall

Shetland Islands Council

I acknowledge receipt of your request for further information. You will receive a response from the Council as quickly as possible, but within 20 working days. If you do not receive a response by 20 November 2020, please contact me.

Title of the procurement Name of the challenging company

Replacement Health & Social Care System OLM Systems Limited

I trust that this response meets your request. However, if you are dissatisfied with the way in which the Council has dealt with your request for information then you may ask the authority to review its actions and decisions in relation to your request, by submitting a formal appeal. The process for lodging appeals is set out in the attached leaflet.

Dear Shetland Islands Council,

Thank you for providing this information. I'm sorry to have put you to the trouble.

It's interesting that only one company has challenged the council. This suggests that your procurement processes are working well.

As an aside, I was surprised to see that OLM Systems had made a challenge - given their presence in Scotland this seems to be a risky decision, but that's a commercial question for the company, I suppose. They used to be a major player in England, I think Scotland is their last redoubt, so maybe they're fighting to the last man!

Yours faithfully,

Steve Hall
