Dear Mr Abdulla,

Your information request - F19/10249/ME

Thank you for your email dated 29 June, in which you ask for various data
regarding CESR applications from 2016 to date.

How we will consider your request

You’ve asked that we consider your request under the Freedom of
Information Act 2000 (FOIA). The FOIA gives us 20 working days to respond,
but we’ll come back to you as soon as we can.

Who to contact

Mark Ellen will be handling your request. If you have any questions you

Dear Mr Abdulla

Reference: IAT/ME/F19/10249

Thank you for your e-mail, below.

The attached tables provide the answers to Q1-4 of your request.

As regards your query about the names of doctors who were added to the
specialist register via the CESR route; this is not information that we
publish and I consider that the following exemption, set out in the
Freedom of Information Act 2000 (FOIA), applies to this part of your
request:

Section 40(2), by virtue of section 40(3A)(a) - This exemption applies
where the information is the personal data of a third party and where
releasing the information would breach any of the principles relating to
the processing of personal data listed at Article 5 of the General Data
Protection Regulation (GDPR). In this instance disclosure would breach the
first principle, which requires the processing of information to be fair,
lawful and transparent. I do not believe that any of the legal bases for
processing listed at Article 6 of the GDPR are met and therefore giving
you the information would be unlawful.

Your right to appeal

You can appeal against the refusal aspect of my response by contacting
Julian Graves, Information Access Manager.  If you want to appeal, please
set out your reasons and email [1][email address]. If such an
appeal were unsuccessful you would have the right of a further appeal to
the Information Commissioner, the regulator of the FOIA –  Julian will
provide more details about this further right of appeal if applicable.

Kind regards

Mark Ellen

Dear General Medical Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of General Medical Council's handling of my FOI request 'CESR information regarding total numbers'.

I was told that the name of doctors on the specialist register could not be given!
I am surprised because of the following reasons:
1- The names of these doctors are already in the public domain and can be found through the GMC website.
2- I made a similar request in 2017 (see link below) and was given all the names I asked for. As far as I know no new regulations were introduced since then to prevent publsihing the names!
Please click on the link below

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...
