Re: Your Recent Request for Information
I am writing in response to your recent request for information regarding
the Lansdowne/Hanover insulated cladding scheme, request number FOI0091.
Sheffield Homes would draw to your attention the provisions of Section
8(1) of the Freedom of Information Act 2000 -
“8 Request for information..
(1)In this Act any reference to a “request for information” is a reference
to such a request which- .
(a)is in writing, .
(b)states the name of the applicant and an address for correspondence, and
.
(c)describes the information requested. “
Case law makes it clear that whilst an e-mail address is acceptable, the
use of a false name is not. Sheffield Homes have reasonable grounds to
consider that “Vera Cold“ is a false name. Any request which is made under
a false name is invalid and Sheffield Homes could treat it as not being
made. If this is not the case Sheffield Homes do apologise in advance,
however Sheffield Homes would require verification of your identity,
amongst other things to comply with its duty under the Fourth Data
Protection Principle
“4 Personal data shall be accurate and, where necessary, kept up to date.”
Sheffield Homes would be in breach of its duties under the Fourth Data
Protection Principle if it didn’t.
You can verify your identity by providing us with a clear colour photocopy
of a driving licence, passport or other similar identity document to the
address set out above, which will be handled in accordance with the Data
Protection Act 1998. Alternatively you may in person bring the original to
a housing office or first point, to be verified by arrangement. Once your
identity has been verified you will be provided with the information
requested in accordance with the terms of the Freedom of Information Act
2000.
If you wish to dispute the determination to seek to verify your identity,
you may do so through making an internal appeal against this
determination, and if dissatisfied with that you may then refer the matter
to the Information Commissioner at the following address.

Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Sheffield Homes Limited's handling of my FOI request 'CERT/CESP'.
The rules state there needs to be an e-mail address to send a response to, so please comply with the rules and send my reply. You have had 20 days to tell me this spurious excuse, yet you have left it until 16 days to send this excuse out.
I do not think you have any grounds at all to refuse this request, or ask what you have. I have complied with the law to request this information.
Please do an internal review as to why you have stated a totally incorrect point to provide the requested information. Your openness, honesty and transparency seem to be acutely lacking. This is why the FOI Act was created in the first place. To ask for information which should be provided but for some peculiar reason is not being.
Please do not use such evasion as an excuse again.

Thank you for your email of 20 February. I have conducted an internal
review of our response to your Freedom of Information request. After
considering guidance from the ICO, I am satisfied that your request has
been handled in accordance with the FOI Act. We have reason to believe
that you have not provided your real name. We will only consider your
request once you have proved your identity as previously requested.
The Information Commissioner provides guidance on the legal requirements
for a request, as follows:
