Dear Mrs O’Reilly,

 

I refer to your Freedom of Information request dated 2^nd February 2017
and please see below the information that you have requested.  Our
information has been collated within the Academic year.

 

 1. In each of the last three years, how many allegations have there been
of school staff causing harm to pupils in Ceredigion schools?

 

2014-15 – 6

2014–16 – 6

2016-17 - 10

 

 2. In how many of these cases each year has the multi agency referral
form been used to report the allegation?

2014-15 – we do not hold the data for this

2015-16 – 3

2016-17 – 8

 

 

 3. Please provide the answers to the above questions broken down by
school.

 

Due to the small number of cases per school we believe that disclosure of
the names of the schools may lead to individuals being identifiable
therefore the name of the schools are exempt from disclosure under section
40(2) of the FOI Act which states that information is exempt from
disclosure if it is personal data and its disclosure would breach any of
the data protection principles in the Data Protection Act (DPA) 1998.
Under the first data protection principle, personal data can only be
disclosed where this would be fair and lawful and in accordance with at
least one condition in Schedule 2 of the DPA. The Department takes the
view that the individuals concerned would have had no reasonable
expectation that their personal data in this case would be likely to be
made publicly available. Furthermore, the Department takes the view that
there is no particular public interest served by the disclosure of this
information which would override the individuals' expectations of and
right to privacy. We therefore consider that disclosure would be likely to
breach one or more of the data protection principles and that the
exemption at s.40(2) of the FOI Act therefore applies to this information.
