Century Park Development Project and Notifying the Secretary of State

Dear Luton Borough Council,

Under the Freedom of Information Act (2000), I request the following information within 20 working days; i.e. by Friday 16th June 2017.

Luton Borough Council, London Luton Airport Limited (Company Registration No; 02020381) and London Luton Operations Limited (Company Registration No. 03491213) are collaborating to bring forward the development of an Industrial Estate and access road onto what is now a large local park called “Wigmore Valley Park”. Since February 2017, these three entities have been running “public pre-consultation exhibitions”. They have notified stakeholders and public that these are in preparation for a “full planning application in June 2017”.

1) To date then, at this pre-planning application stage, has Luton Borough Council notified the Secretary of State about any aspects at all of this project including the following:-
a) The Century Park Industrial Estate building plans?
b) The Century Park Industrial Estate’s new road access across the current Wigmore Valley Park?
c) The New Century Park; namely a relocation of space to substitute the lost “Wigmore Valley Park”?

2) If so, please provide the correspondence that was sent regarding any of these developments, notifying the Secretary of State.
3) If not, what correspondence exists in preparation for notifying Secretary of State of any of these developments in the future?
4) Will the Council be notifying the Secretary of State about this planning application any further, and if so what is the schedule by which it intends to do so?

Further to your request for information of 20^th May, I can respond to say
that we do not hold the information requested. However we respond as
follows to your requests:-

 

 1)To date then, at this pre-planning application stage, has Luton Borough
Council notified the Secretary of State about any aspects at all of this

It is the role of the Local Planning Authority to notify the Secretary of
State (SoS) but under certain defined circumstances and at the appropriate
time (as set out in the attached document ). However the requirement for
notification to the SoS does not apply at this pre-application stage.

2) If so, please provide the correspondence that was sent regarding any of
these developments, notifying the Secretary of State.
Not Applicable

3) If not, what correspondence exists in preparation for notifying
Secretary of State of any of these developments in the future?
LBC will correspond with SoS if and when required to do so in relation to
this application.

4)Will the Council be notifying the Secretary of State about this planning
application any further, and if so what is the schedule by which it
intends to do so?

The Planning Application is initially made by the Developer (LLAL) to the
Local Planning Authority; it is currently anticipated that the application
for planning permission for the road, together with the new layout of
Wigmore Valley Park and the New Century Park employment site will be
submitted in July. The SoS would only get involved should they decide to
“call in” the application.
