CCFC Football Stadium Plans

We're waiting for Martin Goodman to read recent responses and update the status.

Dear University of Warwick,

Following the wonderful news regarding a permanent home for CCFC on the University of Warwick site (https://www.ccfc.co.uk/news/2020/july/ne...).

Can I please request the following:
-Correspondence to and from the University Vice Chancellor, Executive, Finance or Estates department regarding this decision.
-Minutes of the University meeting(s) where this plan was decided upon.

Whilst CCFC/SISU is a private enterprise, the University is a public institution and therefore many of these details are not bound by commercial sensitivity requirements. The ICO has previously ruled in favour of such applications given the public interest in disclosure. (https://ico.org.uk/media/2617789/fs_5029...)

In the current circumstances I absolutely understand if this takes longer than the standard 20 working days.

Thank you for submitting an FOI request, asking for information from the University of Warwick.

In order to comply with your request, we would be grateful if you could please clarify the following:

It is noted that you would like to receive correspondence to and from the University Vice Chancellor, Executive, Finance or Estates department regarding this decision. Apart from the exception of the Vice Chancellor, the departments you have listed contain hundreds of employees, making this a broad request and likely to exceed the appropriate costs limit under section 12(1) of the Freedom of Information Act 2000. Section 12(1) of the Freedom of Information Act states that a public authority is not obliged to comply with a request for information if the authority estimates that the cost of complying with the request would exceed the appropriate limit. This is currently £450, which equates to 18 hours of staff time calculated at £25 an hour as set out in
the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004.

The University is obliged to offer guidance as to what would be manageable under the costs limit so with that in mind, please can you be more specific and narrow the scope of your request by providing specific job titles. You are able to obtain this information here on our public facing webpages:

The University recently communicated with you regarding your request,
email dated 23 July 2020, advising that from its preliminary assessment
your FOI request, in its current format, would be likely to exceed the
appropriate costs limit under section 12(1) of the Freedom of Information
Act 2000. As explained, this is because the scope of your request, asking
for correspondence to and from the University Vice Chancellor, Executive,
Finance or Estates department, is extremely broad, covering potentially
hundreds of staff members. Fulfilling your request would involve the
University contacting a large number of staff to ask them to undertake
email searches in order to locate, retrieve and extract any relevant
information held, which would exceed the costs limit.

The University estimated that this would take in excess of the 18 hours
allowed under the Freedom of Information Act therefore the cost of
complying with the request would exceed the appropriate limit. Public
authorities are not obliged to work past the appropriate costs limit under
section 12(1) of the Freedom of Information Act 2000. This is currently
£450, which equates to 18 hours of staff time calculated at £25 an hour as
set out in the Freedom of Information and Data Protection (Appropriate
Limit and Fees) Regulations 2004.

The University is obliged to offer guidance as to what would be manageable
under the cost limit and offered what may be feasible to provide (you were
asking to narrow the scope of your request and name specific individuals
and were provided some useful web links), however as the University has
not received any communication containing a refined request, the exemption
under Section 12(1) of the Freedom of Information Act is now engaged.

If you are dissatisfied with the way in which your request has been
handled you can request an internal review within one month of our
response and, in the first instance, you are advised to follow the
procedure outlined here:
