Carmarthenshire Planning Enforcement - Expediency Reports

Dear Carmarthenshire County Council,

Across Wales and England planning departments produce expediency reports prior to taking enforcement action such as issuing Enforcement Notices.

I am aware of the expediency requirement within the Town and Country Planning Act 1990 (sec 172). Having sought advice it appears that this is almost always demonstrated through expediency reports. The RTPI also suggests that such reports should be produced when the LPA declines to take enforcement action.

In each of the last 7 years, how many expediency reports were written in relation to the issuing of Enforcement Notices and how many were written in relation to the LPA declining to take enforcement action?

If the Authority does not produce expediency reports please provide the written procedure or policy that covers this and how expediency is demonstrated and recorded.

I refer to your request for information, which was received on 23rd March, 2023 and has been dealt with under the Freedom of Information Act 2000.

The specific information you requested was contained in your email below.

In response:

Enforcement notices issued explicitly set out the rationale for enforcement taking into account the expedience of action in the wider public Interest.
In the last 7 years, the following number of enforcement notices have been issued
2017 – 18
2018 = 24
2019 = 30
2020 = 6
2021 = 24
2022 = 36
The Local Planning Authority does not produce expediency reports where it has not pursued further enforcement action following an investigation.

If the Authority does not produce expediency reports please provide the written procedure or policy that covers this and how expediency is demonstrated and recorded.

All investigations into a potential breach of planning control are considered by planning enforcement officers. The expediency case is considered in accordance with the policies contained within the national and local planning framework, having regard to the local development plan and to any other material considerations. Each expediency case is a matter of professional judgement based upon guidance set out within the policies and procedures set out within the “Comprehensive guidance to local planning Authorities on handling and deciding Development Proposals”. Planning enforcement cases where it is considered expedient to take further enforcement action are recorded on the department’s information management system.
