Care Staff Negligence
Dear Social Care and Social Work Improvement Scotland,
I'm writing to request information on the number of people in Scotland reported to have gained injury, or died, as a result of negligence from care staff. This should include minor injuries.
I request this information to be broken down by year, dating back to Jan 2011.
If it could also be broken down by local authority then that would be helpful, but not essential.
Kind regards,
Rachel Coburn

Dear Ms Coburn,
Freedom of Information (Scotland) Act 2002
We refer to your following request.
I'm writing to request information on the number of people in Scotland
reported to have gained injury, or died, as a result of
negligence from care staff. This should include minor injuries.
I request this information to be broken down by year, dating back to
Jan 2011.

helpful, but not essential.
The Care Inspectorate has a duty to formally tell you that under the
Freedom of Information (Scotland) Act 2002, Section 17, Notice that
information is not held, we do not hold the information you have requested.
The reason we do not hold the information is because it is for the courts
to determine whether any accident or death is the consequence of
negligence. On each inspection, we look at the quality of care and support
and the quality of staffing. We grade this on a scale from unsatisfactory
to excellent, and all our reports are published online at
www.careinspectorate.com.
The Scottish Social Services Council regulates the conduct of individual
members of staff in care services and they may be able to provide you with
information about cases of professional misconduct they have examined in
each of the years you have requested.
I trust this satisfies your request, however if you have any queries
regarding the information which has been provided please do not hesitate to
contact me on 01382 207 100 or email [email address].
If you are unhappy with our response then you have a right to a review. If
you wish to instigate a review then you can do this by writing to me at
Care Inspectorate

or emailing [email address]
This must be done within 40 working days of receiving this email.
Right of appeal
If you remain dissatisfied with the decision of the Care Inspectorate - in
relation to how we have dealt with your request for information considered
under the FOI(S)A - you have the right to pursue the matter with the
