The statutory deadline for responding to a ‘subject access’ request is one
calendar month from the date when CQC received therefore you should have
received a response no later than close of business 15 October 2021.

 

CQC recognises that failure to respond by that date is a breach of DPA and
GDPR.

You requested an internal review on 20 October 2021.

The Care Quality Commission (CQC) responded by email on 22 October 2021. That email included a spreadsheet containing the requested information. In that email, CQC accepted that our response was late and apologised (all be it that we referred to the request as a subject access request, rather than Freedom of Information, in error).

CQC responded to your request for Internal Review on 26 October 2021. In that response we apologised again that our response was late. We advised you of your further right to complain to the Information Commissioner's Office (ICO).

I accept that CQC's response to your FOIA request was 5 working days late and that this was a breach of section 10 of the Freedom of Information Act 2000. I apologise again but you have been provided with the requested information.
