Dear Sir or Madam,

Following closure of the Healthcare Commission's public remit, can I please have information regarding statutory regulatory powers given to the Care Quality Commission?

Dear Sir or Madam,

Thank you for your response, which didnt replicate very well but I believe I have got the gist of things.

My understanding is that : "The CQC has the regulatory functions of registration, review and investigation conferred on it by the Health and Social Care Act 2008, functions under the Mental Health Act 1983 and a role monitoring deprivation of liberty safeguards under the Mental Capacity Act 2005.

Initially, during 2009/10 the CQC will continue to operate the regulatory functions exercised by its predecessor organisations under the Care Standards Act 2000."

Please advise:
1)What will happen re regulatory functions after 2009/10?

2)Can you refer me to relevant Hansard where this was discussed please?

Yours faithfully,

D. Speers

The most worrying thing is that from 2011, England will not have a National Suicide Prevention Strategy and it appears that regulatory powers will also be withdrawn from the Care Quality Commission around the same time...... who will then be responsible for monitoring things like patient safety etc?

Dear Mrs Speers,
Thank you for your email of 21 September to the Department of Health about
the regulatory functions of the Care Quality Commission (CQC). I have
been asked to reply.
Subject to parliamentary approval of draft Regulations, from April 2010,
the CQC will start to operate a new registration system for health and
adult social care providers, under the powers outlined in the Health and
Social Care Act 2008. Details of the new system can be found in Response
to the consultation on the framework for the registration of health and
adult social care providers and consultation on draft Regulations, which
was published in March and can be found on the Department's website at the
link below.

The table on page 87 outlines the timetable for the introduction of the
new system.
In your email, you also asked where to find the relevant Hansard extract
where this was discussed. During the passage of the Health and Social
Care Bill through Parliament in 2007-08 (prior to the Royal Assent that
would make it an Act), there were a number of debates on Part 1 of the
Bill, which is concerned with the CQC. The index page for the Hansard
record of the bill debates can be found on the Parliament website at the
following link.
