FREEDOM OF INFORMATION ACT REQUEST
I refer to your Freedom of Information request in relation to CQC - NCC
Correspondence Covid19.
Right of Access
Section 1(1) of the Act provides any person making a request for
information to a public authority is entitled.
(a) to be informed in writing by the public authority whether it holds
information of the description specified in the request (which Section
1(6) of the Act designates as the "duty to confirm or deny"), and
(b) if that is the case, to have that information communicated to him.
The right is to obtain access to the information itself and not to the
document or record which contains it.
The Act creates a general right of access to information held by public
authorities subject to various exemptions.
Northumberland County Council confirms that it holds the information you
have requested, please see the following information in response.
In adult social care, there are a large number of people who may
potentially have communicated with the Care Quality Commission during the
period covered by your enquiry, and it is obviously very likely that a
significant number of these communications will have referred in some way
to the Covid-19 pandemic, but after giving this some thought, we cannot
see a way in which we could reliably locate all of these without manual
scrutiny of the text, since the pandemic might be referred to in many
different ways other than as Covid-19, or Coronavirus, having been the
obvious shared background to many different kinds of enquiry or
information, which might naturally be referred to simply with phrases such
as “in current circumstances”, or “in the light of the current
restrictions on social contact”. (In practice, it is also likely that
many of the emails would be about individual safeguarding concerns, which
we would have to redact.) We have therefore decided that we are unable to
meet this request within the limits of our statutory duty and our
practical capacity to carry out this kind of detailed exercise.
