Dear East Sussex County Council,

Please answer the following questions, or as many as is possible within time & cost parameters starting at #1.
1. How do you calculate the level of contribution that adult social care recipients should make to their care packages?
2. What income are social care recipients allowed to retain, after their contribution to their care package has been deducted?
3. What do you allow as Disability Related Expenses? Please provide a copy of your guidance if this is easier.
4. Do you use pre-payment cards for care payments? If yes can people opt out of using these?
5. Are there any restrictions on what Personal Budgets and Direct Payments can be spent on? Please provide a copy of your guidance on this.
6. Please provide a copy of the guidance document that your authority uses to make decisions on Direct Payment packages.
7. Do you have a contingency policy for DP users. If yes please attach a copy.
8. If a PA is off work sick do you provide extra funding to cover their sick pay – as individual employers can no longer get statutory sick pay reimbursed?
9. "What percentage of Direct Payments rates, that are paid to adults who directly employ their own PAs, are allowed to be spent on the following additional expenses?"

• Independent living insurance
• Advertising

Clarification Received 14/12/2016

I refer to how the budget is calculated - however as I am only aware of
one type of DP it would be useful for you to clarify what types are
available in your LA.

 

Response

1.    Please see attachment 1: ‘Financial Assessments’.

2.    Please see attachment 2: ‘Charging for Care’.

3.    There is no prescriptive list for Disability Related Expenses.

4.    Yes, ESCC does use Pre-paid cards and clients cant opt out.

5.    Please see attachment 3: ‘Direct Payments’.

6.    Please see attachment 4: ‘Personal Budget’.

7.    There is no policy for this but ESCC does allow a contingency amount
for all clients employing PAs. In addition, all Direct Payments clients
are paid 4 weeks in advance to ensure they have access to funds in case of
emergencies.

8.    Yes sick pay is included in the Direct Payment budget.

9.    100% - All clients using their Direct Payments to employ PAs can
spend their personal budgets on the items listed above.

 

Further to your request for information on the types of DP available,
please see attachment 5: Types of Direct Payment.

 

FOI 2000 s 40 (2) Personal Data

Some of the information has been removed as it is Personal Data, as
defined Section 1 Data Protection Act 1998 (DPA). Public authorities are
not obliged to release personal data in response to requests under the
Freedom of Information Act (FOIA) because Section 40 FOIA defines personal

which refers to the personal data of third parties. We are therefore
