I would kindly like to be supplied with anonymised/blank/draft copies of the following under the FOIA 2000:
- Child In Need Assessment and Plan,
- Looked After Child Assessment and Plan (including appendix such as a plan covering a child's personal education whilst in care and feed as part of the overall plan),
- Young Carer's Assessment and Plan,
- Adult Carer's Assessment and Support Plan,
- Joint Adult Disabled Person and Carer's Assessment and Plan,
- NHS Funded Assessment and Care Plan (e.g. for Continuing Care) which you may possess,
- Section 117 Care assessment and plan,
- Any reassessment documents which may be completed for each of the above to be used for example when a client's needs may change,
- Written fees charging policy,
- Written social services complaints policy and
- Resources Allocation System Protocol (i.e. how clients needs are calculated to reach an indicative/actual amount that social services will be likely to allocate, not to be confused direct payments per say).
I hope you could provide a copy of your written FOIA procedure or inform me where I might find this, say on your website. Also I would appreciate it if you would inform me prior to disclosing any documents, if you are to exercise a need for payment.

Description : Children and Adults Assessment Plans

Your request is being considered and you will receive the information
requested within the statutory timescale of 20 working days (Freedom of
Information Act 2000/Environmental Information Regulations) or 40 calendar
days (Data Protection access requests).
For your information, the Acts and Regulations define a number of
exemptions which may prevent release of the information you have
requested. There will be an assessment and if any of the exemption
categories apply then the information may not be released. In some
circumstances the decision to release information, or not, will be based
on a public interest test. You will be advised of any considerations,

person details. These are entirely fictitious, and do not relate to any
individual.

Please see attached Children in Need Plan and Child/Young Person’s

- Looked After Child Assessment and Plan (including appendix such as a
plan covering a child's personal education whilst in care and feed as part
of the overall plan),
The Assessment part of this would be a Child Young Person’s Assessment and
the same output as above. The Plan part would be the same report template
as above.

We commission a third party charity (Spurgeon’s) to carry out the
assessment.
- Adult Carer's Assessment and Support Plan,

- Joint Adult Disabled Person and Carer's Assessment and Plan,

- NHS Funded Assessment and Care Plan (e.g. for Continuing Care) which you
may possess,
Information not held.

As Charging Policy.
- Any reassessment documents which may be completed for each of the above
to be used for example when a client's needs may change,
Reassessments would be the normal assessment and report either updated
from a review or a new assessment added. The outputs would be the same as
an assessment.
- Written fees charging policy,
The charging policy has been superseded by the Care Act regulations.

Please see attached two separate documents, one for Adults and one for
Children’s Services.
- Resources Allocation System Protocol (i.e. how clients needs are
calculated to reach an indicative/actual amount that social services will
be likely to allocate, not to be confused direct payments per say).
It is possible that to confirm or deny that the requested information is
held, or to provide the information if it is held, may not be in the
public interest. I am currently assessing this.
The Freedom of Information Act obliges the Council to respond to requests
promptly, and in any case no later than 20 working days after receiving
your request. However, when a qualified exemption applies to the
information and the public interest test is engaged, the Act allows the
time for response to be longer than 20 working days, and a full response
must be provided within such time as is reasonable in all circumstances of
the case. The Council does, of course, aim to make all decisions within
20 working days. In this case, however, I have not yet reached a decision
on where the balance of the public interest lies.
It is anticipated that this will require an additional 10 working days to
process. If this timescale needs to be revised you will be advised as to
the reasons and provided with a revised timescale.
The specific exemption which applies in relation to your request is:

considered and it is not possible to meet your request.
After careful consideration of all the relevant factors and the provisions
of the legislation, it is considered that disclosure of this information
is not in the public interest.
- Resources Allocation System Protocol (i.e. how clients needs are
calculated to reach an indicative/actual amount that social services will
be likely to allocate, not to be confused direct payments per say) have
been exempted on Section 43 (2) - Commercial Interests grounds.
This Commercial Interest exemption applies because disclosure of the
information requested would, or would be likely to prejudice the
commercial interests of the Council.
In accordance with the Freedom of Information Act 2000 this letter acts as
a Public Interest Refusal Notice.
There is a general public interest in the disclosure of commercial
information in order to ensure:
· that there is transparency in the accountability of public funds;
· that public money is being used effectively, and that departments
are getting value for money when purchasing goods and services;
· that departments' commercial activities, including the procurement
process are conducted in an open and honest way; and
· that business can respond better to government opportunities.
However, the overriding reasons why the public interest favoured
withholding the information in this case were:
Public interest would be in the most efficient way of allocating resources
based on actual real and presenting needs. Reduced availability of social
care support through increased budgetary pressure would not be in the
greater public interest
