An excellent and comprehensive piece of Statutory Guidance issued by the Department of Health effective 09 December 2016 and well worth a read.
The Care and Support Statutory Guidance has been a long time coming, and has been issued to all NHS providers following a long period of consultation, on 09 December 2016.
Under FOIA, I wish to know if this entire guidance is now effectively in place within your trust, along with all current Legislation , NHS Constitution standards, and other guidance issued under NHS guidance and Legislation ?
Will you please provide me with all documentary information you hold, that will allow me to see, since the update on 09 December 2016 , how the DOH Care and Support Statutory Guidance has been, at all levels , identified, considered , introduced and now implemented within all of your policies and procedures and service standards.
I need to meet with a number of senior figures within your trust soon, and wish to ensure they are fully aware of the trusts, and their own individual, duties and responsibilities to me following the introduction of this Statutory Guidance, and of course all other Legislation and best practice updates introduced over recent years.

The Trust has now had the opportunity to fully consider your request and
responds as follows:

The Department of Health Guidance that you refer to and updated 9^th
December 2016 was a document originally published in March 2016.

For your information the update on 9^th December according to the GOV.UK
website  was an update to chapter 19 to reflect the department's position
on the determination of questions of ordinary residence following the case
of Cornwall Council v Secretary of State for Health.

The Trust had carried out the necessary review of services based on the
March document. The document required the Trust to review its Safeguarding
procedures/services in light of the guidance that had been issued  and the
Trust Safeguarding Policy was duly updated during 2016 so that the
document is compliant with local and National guidance. A copy of the
document is attached, as is the redacted report from our Safeguarding lead
to the local Joint Safeguarding Group in July 2016 reflecting that the
Safeguarding Policy has been updated. This document has been redacted to
ensure that the Trust meets its obligations under the Data Protection Act
so that all data is redacted except for the relevant parts to this FOI and
because the report contains information concerning actual cases and
incidents and personal information.
