Dear Wigan Metropolitan Borough Council,

WIGAN Council is being monitored by the Information Commissioner’s Office (ICO) for being too slow to respond to freedom of information (FOI) requests.

It is one of four councils being told that it needs to improve its practices after the ICO received a ‘significant’ amount of complaints about delays in their response times.

The others are the London Borough of Lambeth, the London Borough of Tower Hamlets andWarwick District Council.

ICO deputy commissioner, Graham Smith, said: “The four councils we have named should see their inclusion on the latest monitoring list as a clear signal that they need to improve their practices.

“Responding to FOI requests within the permitted time frame is one of the cornerstones of ensuring transparent local governance.

“We will be happy to work with the councils in their efforts to turn their performances around.”

Under the Freedom of Information Act, public bodies must respond to a request within 20 working days.

Donna Hall, chief executive of Wigan Council, said: “The number of FOI requests sent to Wigan Council has more than doubled in the past four years and dealing with them now costs more than £120,000. This comes at a time when the council is making cuts of £110m.

“By law, public bodies have to respond to requests within 20 working days, which with reduced resources can prove a difficult and time consuming task. We are working hard to make sure most of our information is made available online via our website, which should reduce the number of enquiries we have to process.

“We’re also working to improve our handling of these requests. In June, we recruited a new information officer to manage the FOI process. Since this appointment, there has been a 15 per cent increase in response times. “We’ve changed processes and structures within the council to speed up the response times and have been raising awareness among our staff of the importance of responding quickly.

“I’d like to stress we aim to be an open and transparent organisation and this issue is being taken seriously throughout the council.”

Information Regulations 2004.

The response to your request is detailed below.

I am unable to provide you with the information that you have requested
under Regulation 12 (4) d of the Environmental Information Regulations
2004.  I can confirm that the information is held, however this document
is a plan handed to the Leader of the Council, that plan is a draft
document in relation to a development of land which is currently in
pre-planning stage and all plans in relation to the development are
subject to change.  

Having applied the public interest test, it is in the public interest to
have accurate information in the public domain and the disclosure of this
plan would provide an in-accurate and mis-leading perception to the public
in relation to land development which would have a negative impact on the
community which would be both un-warranted and irresponsible on our part. 
It would also distract proper and considered debate should a planning
application be made for the land.

If you are unhappy with any aspect of this response, an independent senior
officer will review this decision. Please let me know if you would like to
arrange this.

As the application was advertised by the applicant on the counter of his chip shop by way of a petition for customers to sign in favour of,and giving the drawing number so the customer can decide whether to sign the petition or not,it is in the public interest for any members of the public to see these drawings.Otherwise,any signatures,given in favour of the plan that already exist are null & void because they have'nt been given the plans to view and then make a decision.Because many customers have/did sign the petition,then it is in their interest to see what plans they have agreed with on the said petition the applicant has asked them to sign.I await a faster response this time.

I am writing to respond to your request for a senior officer review of Wigan Council's decision in relation to your freedom of information request ID 5953. You have requested a review of the response to your FOI request which you submitted on 12th June 2014.

My decision on review is that the Council has correctly applied the exemption in Regulation 12(4)(d) of the Environmental Information Regulations 2004 and has correctly applied the public interest test. The planning application process is still at the pre-planning stage. I consider that a developer should be able to have discussions with a local authority regarding a proposed development at a pre-planning application stage without the local authority being required to release that information to the public under the 2004 Regulations.

A planning application has not been made for the land. If a planning
application is made for the land in the future, local residents and
businesses will be formally consulted by the Council and their views taken
into account. The Council has already given reasons as to why a draft
plan, handed to the Council by the owners of the chip shop should not be
released under FOI in response to FoI 5953.  That plan is a draft document
in relation to a development of land which is currently in pre-planning
stage and all plans in relation to the development are subject to
change.

What i am asking is

1)Will the applicant(green lane chippy) be able to produce to the council,a list of signatures taken in FAVOUR of his plan that he advertised on his counter under drawing number W./14/24/02 many many weeks ago?

2)Will the signatures in question be looked on favourably by the council in deciding to give full planning permission?Bearing in mind those that signed have NOT seen drawing number W./14/24/02 so would i be correct in believing these signatures will be worthless if provided by the applicant?

"Your email to us dated 23rd October following our second response to FoI 6407 dated 23rd October has been referred to a Senior Officer to carry out an internal review "

Your reply dated 20th November 2014 has NOT come from from an internal review.

2) In your reply dated 20th November 2014 you wrote:

"and confirm that Council officers do
not hold, nor have seen, a petiition or list of signatures such as that
referred to."

I did'nt ask if officers "held"or "had seen" a petition or list of signatures.

I shall ask again below:

1)WILL the applicant(green lane chippy) be able to PRODUCE to the
council,a list of signatures taken in FAVOUR of his plan that he
advertised on his counter under drawing number W./14/24/02 many
many weeks ago?

2)WILL the signatures in question(IF HE PRODUCES THEM) be looked on favourably by the
council in deciding to give full planning permission?Bearing in
mind those that signed have NOT seen drawing number W./14/24/02 so
would i be correct in believing these signatures will be worthless
if provided by the applicant?

Dear Mr Smith,
 
I am writing to respond to your request for a senior officer review of
Wigan Council's decision in relation to your freedom of information
request ID 6407 that you submitted on 23rd October 2014 in relation to
Green Lane Chippy, 507-509 Holden Road, Leigh. You requested the following
information:

1)Will the applicant(green lane chippy) be able to produce to the
council,a list of signatures taken in FAVOUR of his plan that he
advertised on his counter under drawing number W./14/24/02 many many
weeks ago?

2)Will the signatures in question be looked on favourably by the
council in deciding to give full planning permission? Bearing in mind
those that signed have NOT seen drawing number W./14/24/02 so would i
be correct in believing these signatures will be worthless if provided
by the applicant

 
Wigan Council's response on 20th November, was as follows:
 

"We believe we have already provided you with information requested in
relation to this FoI and to FoI 5953 and confirm that Council officers
do not hold, nor have seen, a petition or list of signatures such as
that referred to."

You have requested a review of that response.

My decision on review is that the Council has not previously answered the
two questions that you have asked. The answer to your two questions is as
follows:

1)    Yes. However, there is no planning application submitted for the
site. If the Green Lane chippy owner did make an application then it
would be up to him what evidence he submitted to support his case.

2)    If a planning application was submitted, and a petition was
included as part of that submission or was submitted subsequently, then
the Council would have to take it into account in reaching a decision.
It is up to the Council however to decide what weight, if any, should be
placed upon a petition. Petitions generally have as much status as an
individual letter as it is the issues which the petition raises, not how
many people have signed it, which is the most important consideration.
This would be the same for a petition against a proposal as it would for
one in favour.
