On the 19th February, 2014 the Council granted planning permission for the Health Centre and Pharmacy at Mill Street, Llangollen under code 03/2013/1374/PF.

Under Condition 8 it was stipulated that “the car park shall not be brought into use until the written confirmation has been obtained to the proposed management arrangements for the use of of the parking areas outside core operating areas”.

Please provide a copy of the written confirmation duly provided together with any conditions imposed pursuant to that consent as to the management arrangements?

Dear Kerry,

I wonder if you have now heard anything further from your Planning Department regarding this issue.

My reason for enquiring is that I am Co-Event Director for Old Railway Trail parkrun which was launched just over ten weeks ago and takes place every Saturday morning at 9 am. The event has settled down now after we were inundated with 249 runners the first week. We are still getting over a hundred people taking part each week where people can walk, jog, run or volunteer to enhance their health and wellbeing.

We are advising people attending to park in the public car parks in Llangollen, so it would be useful to know the status of the car parks either side of the Health Centre. The car park on the town side of the Health Centre is used by patients visiting the Pharmacy so we do not want park runners using this area to the disadvantage of patients. Our Start/Finish area is in the car park on the other side of the building(Trevor side) and this gives access and egress to the Old Railway Trail. Again we are actively discouraging people attending our parkrun to use this area, but would like to know it’s official status?

In setting up our parkrun we have had support from David Shiel and his Team at the Countryside Service/AoNB Partnership together with Sport Wales and Welsh Athletics, The GP Practice who are a parkrun practice and the Friends of Llangollen Health Centre and it is running smoothly with excellent feedback from participants, several of who come from far and wide known as parkrun tourists.

I hope you can clarify the issues and status of the car parks at the Health Centre because we do not want to misinform people whether they are able to park or not in those areas?

I wrote to you in August last year regarding parking at Llangollen Health Centre and you were liasing with the Planning and Parking Departments.

I explained fully in my email the reasons for this request in relation to the activities of Old Railway Trail parkrun, Llangollen and our wish not to cause problems on a Saturday morning for patients visiting the Pharmacy or for specific events at the Health Centre which is normally closed on a Saturday mornings.

Unfortunately I do not seem to have received a reply from you and would be grateful to receive a reply now as soon as possible?

You seem to be confusing my general request in relation the parking revenue which was dealt, with with this specific request in relation to the car parks(patient) and (Staff) either side of the Health Centre Building.

I can see that we provided a response : "We don’t have any record of the management plan referred to - the information is not held. Planning and Parking will take the matter forward."

As the matter - the issue - was passed to Planning and Parking, I had no further dealings with the case as we had moved on from the FOI.

Yes that’s the one.

I am Co-Event Director of the Old Railway Trail parkrun, Llangollen and occasions we have had difficulties clarifying with participants and our Team of Volunteers whether the public have any rights to park in the car parks on a Saturday mornings when our events take place. This can be particularly problematic when the Health Centre holds Vaccination Clinics and we have to marshal those car parks to prevent people causing issues for users of those clinics and of course the Pharmacy which is open on Saturday mornings.

We would simply like to know what has been agreed if any thing with the Health Board by your Planning Officers in compliance with Condition 8 of the Planning Permission referred to in my request?

I apologise for the delay in responding to this email. This is the response from Planning:

Unfortunately, as the planning condition was imposed over 10 years ago this means the LPA cannot now enforce it. This rule applies as, if there have been no issues over that period, it is assumed the condition was not necessary.

This appears to be a civil matter between the landowner and any organisers of parkrun events.

We had hoped to obtain the view of the Traffic Manager, but he is now on leave until the 11th November.

I request an internal review of Denbighshire County Council's handling of my FOI request 'Car park at Llangollen Health Centre'.

The Planning Officer imposed a condition in relation to car parking at the Health Centre in Llangollen and then failed over several years to follow up on this condition and to regulate the use of the car parks on either side of the building. This is causing increasing problems for the Pharmacy on weekends and also there is increasing unregulated use of the staff car park on weekends and particularly when the Health Board and GP Practice hold Vaccination Clinics. The Old Railway Trail parkrun which is held every Saturday morning( 72nd event last Saturday) discourages participants from parking at the Health Centre, but this is difficult to regulate when there is no clear definition of who can use the car park which is also used by people walking on the Nature Trail to and from Wenffryd Nature Reserve.

Your request is headed internal review , but because of the time which has

request. There is no request for recorded information in your email in the
chain below , so I have looked again at your original request.

On the 19th February, 2014 the Council granted planning permission for the
Health Centre and Pharmacy at Mill Street, Llangollen under code
03/2013/1374/PF.

Under Condition 8 it was stipulated that “the car park shall not be
brought into use until the written confirmation has been obtained to the
proposed management arrangements for the use of of the parking areas
outside core operating areas”.

Please provide a copy of the written confirmation duly provided together
with any conditions imposed pursuant to that consent as to the management
arrangements?

With our answer: ‘ We don’t have any record of the management plan
referred to - the information is not held’ It seems that the service may
have interpreted your request narrowly, only looking for a management
plan. I will therefore represent the request, albeit as a new request.

Your further emails, including the email below, are about the issue and
are not requests for recorded information, and therefore cannot be
considered under FOI. However, as before, I will ask the Services to look
into the matter again.

Thank you for your request for information received 04/11/2024 concerning 
the car parking arrangements at the Health Centre and Pharmacy at Mill
Street. I have received a further response from Traffic, which may assist:

We have searched our files and, unfortunately, we do not hold records of
any written confirmation regarding the management arrangements for the
Llangollen Health Centre car park. We also don’t hold any other documents
that detail either the operation or the management arrangements relating
to the car park.

At least two site meetings took place during the construction of the
Health Centre between Denbighshire County Council highway officers and a
representative from the Estates Department at Betsi Cadwaladr Health
Board. A number of different options were discussed and considered but
none of these were without problems and it was decided that the distance
from the staff car parks to the Town Centre meant that any usage by
visitors was likely to be fairly minimal. It was also reasoned that apart
from some occasional overlaps in demand (during the summer holidays for
example); the main demand for additional parking would occur at weekends
when the Health Centre is (normally) closed.

The problems described in previous correspondence seem to relate to
problems when weekend vaccination clinics are operated in the Health
Centre and for the pharmacy. As this is a car park owner by Betsi
Cadwaladr, there is nothing to prevent them from still seeking to regulate
parking as the owner of the site. This could include measures such as
limiting the maximum stay to an hour, with exemptions for staff, which
would presumably deter tourist visitor parking.
