Dear Blackpool Borough Council,

I am writing to request an internal review of Blackpool Borough Council's handling of my FOI request 'Car Park'.

Thank you for your reply but you have swerved most of my requests.

As you should know planning permission is required for ANPR cameras and signage needs advertising consent. It is your duty to answer my questions in the detail I request, not tell me to search myself. And investigate the private parking company if they have illegally done all this without planning consent or/and advertising consent.

Cameras mounted on new, dedicated free-standing poles (as most ANPR cameras are) normally require planning permission

LPAs consider parking signs each smaller than 0.3sqm in area as having ‘deemed consent’, and signs exceeding this size as not having deemed consent but requiring ‘express consent’ under Class 2, Schedule 3 of the Town and Country (Control of Advertisements) (England) Regulations 2007 (or the Welsh equivalent, the 1992 Regs).

The situation for advertisement consent is quite different. Advertisements do not become immune from enforcement until 10 years after installation. Anyone who displays an unauthorised advert commits a criminal offence, and it is immediately open to the LPA to bring a prosecution in the Magistrates’ Court under s.224 of the Town and Country Planning Act 1990. The penalty on conviction is currently up to £2,500, and in the case of a continuing offence a further daily fine of up to £250 until the contravention ends
