I am writing to request an internal review of Kent County Council's handling of my FOI request 'Cantium solutions KPI'.

I do not believe this simple request around KPI’s wild disadvantage cantium or put its competitors in an advantageous position by knowing this information.

As a tax payer, and cantium receiving significant funding from the council and essentially being a major supplier to the council, I wish to know what KPIs the success and value for money of this unit is being judged on.

It doesn’t seem right that councils can essentially hide behind mis-use of tax payers money and not be accountable buy setting up a latco.

Thank you for your email below.

I am sorry that you were unhappy with our handling of this request for
information. As part of the review process, I have revisited your original
request (attached for ease of reference) and uphold your complaint that it
was inappropriate to cite section 43 of the Freedom of Information Act
2000, prejudicial to commercial interests, to legitimise the
non-disclosure of Key Performance Indicators relating to the services
provided by Cantium Business Solutions.

In March 2019, a report was presented to the Policy & Resources Cabinet
Committee (which meets bi-monthly) detailing the delivery of KCC services
since the establishment of Cantium Business Solutions in July 2018 and the
Key Performance Indicators that apply to the services they provide.

Since then, further statistics have been reported to Policy & Resources
Cabinet Committee, most recently in September, and this will continue for
the duration of the contract.

Therefore, as the information is already in the public domain, we should
not have stated it was commercially sensitive and the FOIA exemption that
we should have relied upon was section 21, information already accessible
to you by other means.
