Cancellation of school bus driver CRB/DBS Pink Badges

We're waiting for Mr Fairchild to read a recent response and update the status.

Dear North Yorkshire County Council,

When each of the following bus operators ceased trading (or perceived cessation of trade in the eyes of NYCC), please can you advise whether or not NYCC made a decision to summarily cancel the drivers' pink badges of the staff of each operator as follows:

Little Red Bus July 2013
Sandla Aug 2013
Pennine May 2014
Eddie Brown Dec 2014
Tower Travel Sep 2016
Utopia Aug 2017

Where the drivers of an operator identified above did suffer revocation of their DBS pink badge, please provide a copy of the generic correspondence issued to other operators in each case.

Drivers/Passenger Assistants holding NYCC DBS badges in the name of the
following companies were requested to return their badges.

 

Tower Travel

Utopia

 

The emails sent to all NYCC contractors regarding the use of Drivers and
Passenger Assistants on NYCC contracts for both Tower Travel and Utopia
are attached.

Where necessary we have removed officer names from the information
disclosed to you as we consider these to be the personal data of the
officers. As such we are withholding this information under section 40 (2)
of the Freedom of Information Act 2000 which exempts personal information
from disclosure if disclosure would breach one or more principles of the
Data Protection Act 1998. In this case we consider that disclosure would
breach the first principle, namely that personal information must be
fairly and lawfully processed and must meet one of the conditions for
processing as provided by schedule 2 of the Act. In this case we consider
that the disclosure would be unfair and unlawful and none of the
conditions for processing would be met.
