Canal Basin Ownership

Response to this request is long overdue. By law, under all circumstances, Craven District Council should have responded by now (details). You can complain by requesting an internal review.

Common Law Jurisdiction

Dear Craven District Council,

I write in reference to this article:
http://www.cravenherald.co.uk/news/15093...

1. Do Craven District Council actually own the canal basin (or any part of it, most specifically the one referred to in this article) or do you hold it in trust or neither?

2. If you do own it please provide recorded proof of ownership.

I don't like these marches as I think the world is plenty big enough not to cram everyone in to certain places whilst leaving vast parts of the world fairly deserted, but I don't see what authority you have to stop these protests.

"Bart Joseph"
Yours faithfully,

Thank you for your request for information received on 16 February 2017. This request will be dealt with in accordance with either the Freedom of Information Act (‘the Act’) or the Environmental Information Regulations (‘the Regulations’) (whichever is appropriate). You asked for:-

As set out in the e-mail below:

You can expect a reply by 2 March 2017 unless I need to come back either to you to clarify your request or the Council needs more time to deal with your request. In this latter eventuality, for requests dealt with under the Act, delays can sometimes arise where the public interest needs to be considered. In the case of requests dealt with under the Regulations, a delay can arise if the Council believes that the complexity and volume of the information requested means that it is impractical to comply with the request by the date specified, or to make a decision to refuse to do so.

If you have any queries about this letter please contact me quoting the reference number above.

If you are not happy with this response you may request an internal review by emailing [Craven District Council request email] or by writing to the Freedom of Information Officer, Craven District Council, Belle Vue Square, Broughton Road, Skipton, North Yorkshire, BD23 1FJ. Any request for a review should be submitted within two months of the date of this letter.

If you are not content with the outcome of the internal review, you may apply directly to the Information Commissioner’s Office for a decision. Generally the Commissioner cannot make a decision unless you have exhausted our own complaints procedure. The Information Commissioner’s Office can be contacted at the Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF.

Dear Craven District Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Craven District Council's handling of my FOI request 'Canal Basin Ownership'.

I feel we are getting in to the usual Craven DC wordsmithery here. I didn't ask about "assets".

I asked this:

1. Do Craven District Council actually own the canal basin (or any part of it, most specifically the one referred to in this article) or do you hold it in trust or neither?

Your response does not answer this for me. Please state if you own/hold in trust or neither of those for the canal basin and rest of the canal.

2. If you do own it please provide recorded proof of ownership.

Fairly straightforward please disclose lawful deeds of ownership.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...

Yours faithfully,

Common Law Jurisdiction

Dear accesstoinfo,

Thank you for your reply. I want to cut through all the spiel here. I am wanting a simple answer.

I am having to read between the lines as I am getting the usual vague and not fully decisive answer. What I am getting from your replies is that you are saying the following:

Craven District Council own the land mentioned in the Craven Herald, that you hold lawful deeds to it and that you do NOT hold it in trust and instead properly own it.

Is that correct?

If so I may drop wanting the deeds. Although I am entitled to ask you to provide them, I will trust you not to lie if you give me a straight and clear answer.

Yours sincerely,

Common Law Jurisdiction

Further to the message received today, a decision has been given by the Council on the request for an Internal Review, and the relevant appeal rights were enclosed.

No additional response will be sent.

Common Law Jurisdiction

Dear accesstoinfo,

So you are incapable of giving a yes/no answer to a simple question. It is getting rather tiresome, but we will have to go to the ICO again and I am sure they have better things to be doing.

Yours sincerely,

Common Law Jurisdiction

Hello ICO

Hopefully the helpful man will respond to this.

I would like to report Craven DC again for failing to give a clear answer to a request.

I want to clarify if they own a piece of land, but find their answer showing it as an "asset" vague. They have also refused to clarify to me if they truly own this land or if they hold it in trust. I honestly cannot make it out from their usual vague answers so want a clear and unambiguous answer. This they refuse to give.

Regards and thanks
Bart Joseph
