Could you also please release the dates, times, and locations of any future planned meetings of the Shadow Police and Crime Panel, Police and Crime Panel, or its sub-committees and details of any arrangements for public attendance.

Panel is supported by Peterborough City Council whose contact details are as follows... "

Dear Cambridgeshire County Council,

I would like to request an internal review of the council's response to my FOI request, your reference FOI 2247, for material relating to Cambridgeshire's Shadow Police and Crime Panel meeting held on the 12th of September 2012.

I have seen some of the material requested in Shire Hall, the meeting papers were picked up and brandished by Cllr Richard West during the public Safer and Stronger Communities Overview and Scrutiny Committee on Thursday 13 September 2012 which I was observing.

I would like the review to check that no council officers have a copy of the material requested.

If council officers do not hold the requested material I would like it to be considered if material held by councillors is in fact held on behalf of the council and ought be released in response to my request. The Information Commissioner has produced guidance* suggesting that information held by councillors on behalf of or as part of the local authority will be covered by the Freedom of Information Act, and that roles such as "representing the authority, for example, on a regional forum" are carried out on behalf of the authority. I would like the council to consider if this applies in this case.

Further to my email acknowledgement of 1 October 2012, in which I advised
you that you could expect a response by 15 October 2012, please accept my
sincere apologies for the delay.
 
We are currently investigating the handling of your initial request and
unfortunately, it has taken longer than we first anticipated.  There are
likely to be further developments later in the week and we wish to
investigate these fully so that we can provide you with a complete
response.  It does mean, however, that we will be unable to respond until
the end of this week.

The internal review concludes my request was wrongly refused, the council did hold the information requested which has now been released.
