We write to inform you that we no longer need you to disclose the email platform you use as we have identified that you use Microsoft Outlook 365.

We are very familiar with this software and are aware that it has powerful and extensive search features which would scan the 3,000+ employee email accounts for a particular search string in mere seconds, so we reject the assertion that providing the data would exceed the cost limit.

With respect to the cost limit exemption you claim, we note that you did not include a calculation or explanation of the costs involved in providing the information. It would be useful if you could do so, to allow us to understand how best to reframe our request and not exceed the cost limit.

As we are sure you are aware, the Freedom of Information Act states that it is "the duty of a public authority to provide advice and assistance, so far as it would be reasonable to expect the authority to do so", and the Information Commissioner's Office consider it best practice to provide "arguments or evidence" when applying this exemption.

Please provide the calculation and explanation of the costs, along with disclosure of the emails, as originally requested.

To provide you with a list of names of individuals would entail valuable officer time that is not available, as once we have ascertained that a request would take longer than that allowed under the cost limit set under the Freedom of Information Act, as already advised, there is no obligation to spend further time on it.

To quote the Information Commissioner's Office advice, "as soon as a public authority becomes aware that it intends to rely on section 12, it makes sense for it to stop searching for the requested information and inform the complainant. This avoids any further and unnecessary work for the public authority as it does not need to provide any information at all if section 12 is engaged."

Whilst as you know we strive to provide assistance in refining requests where possible, in line with the ICO guidance "the duty to provide assistance and advice under section 16 is expressly qualified by the words “only in so far as it would be reasonable to expect the authority to do so"."

As set out in the Freedom of Information Act, the appropriate limit for a Local Authority is set at £450 and costs are to be estimated at a rate of £25 per person per hour. It is therefore estimated it would cost in excess of £850.

Please note there is no statutory requirement under section 17 for the refusal notice to include an estimate of the costs involved or any other explanation of why the cost limit would be exceeded.

We seek clarification on your cost estimates.

Can you explain what the cost of £850 relates to and what, exactly would take an estimated 34 hours?

For the sake of clarity: the information we now require is just the email addresses and the names of the employees to which these account relate which were found to have mentions of "Calderdale Against Corruption" or "Citizen's Anti-Corruption League".

You have already identified 2086 emails which mentioned "Calderdale Against Corruption" or "Citizen's Anti-Corruption League", and a member of our team has spoken to Microsoft Office 360 support who confirmed that it would take less than 10 minutes to export all the email addresses, and the emails, for which a search has been performed, so that clearly falls within acceptable costs for the purposes of the FOI request.

We do not require disclosure of the actual emails, just the email addresses and names of the employees to which the accounts belong. We can then identify which, if any, emails we need disclosing.

We are doing our best to help you with this request and hope you can provide that information as soon as possible.

If the clarified request is refused then we would like to proceed with the Internal Review.
