3. Can CAFCASS confirm that if the FCA ‘without the direction of the court’ feels wider harm ‘may’ occur in terms of a clinical diagnosis the SU has then the FCA applies ‘ The wellbeing tool’ DOH 2000 to form part of risk assessment ?
4. If CAFCASS without direction of the court assess a SU mental health then CAFCASS by virtue of undertaking this assessment have a duty of care and would be breaching this duty in making a MH assessment without qualification to do so and failing to provide informed consent to CAFCASS non MH Act compliant/code of practice for undertaking such an assessment.
