Dear Children and Family Court Advisory Support Service,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Children and Family Court Advisory Support Service's handling of my FOI request 'Cafcass - Broken Britain'.

My complaints are as follows:

1. I asked ..Is it true that your CEO stated that contact with parents should be 50/50 unless there
was a risk to children?

You replied ...This is not a statement that has been made by the Cafcass CEO. This is also not a request for information. Cafcass support shared parenting where post-separation communication between
parents is strong enough to make inevitably complicated practical arrangements work well for a
child.

I state...Your statement is untrue, your CEO does in fact support the view of 50/50 unless their is a risk to children.

2. I asked..Do Cafcass officers follow your CEO's statement?

You replied..Please see 7above. which relates to point 1 above.

I state...You provided untrue statement. Furthermore, your officers do not follow his statement.

3. I asked ...Should either party supply independent proof of a risk to a child and not hearsay?

You replied ... I am unable to answer your question as each case is different and dependent on its individual
circumstance. Cafcass officers are required to work within the guidance of the Cafcass Child
Protection Policy.

I state...You should seek independent evidence to protect yourselves, parents and especially children so a informed decision can be made during family proceedings in the interest of justice and children.

4. I asked....How many Shared Residency orders have been made between between April 2008 and
April 2012?

You replied ...Cafcass does not collect this data on a central database. This information is contained within individual case files. It is not a requirement for Cafcass to keep it centrally.

I state ...In the interest of equality, there is no reason why this information cannot be recorded as a course of your daily business to ensure equality.

5. In terms of point 4, your reply ...Cafcass will be unable to provide the requested information. Section 12 of the Freedom of Information Act
allows a public authority the ability to not comply with a request for information if the cost of compliance exceeds the appropriate limit. The fees regulation state that this cost limit is £450 for all public authorities. Cafcass have considered the time and cost taken to determine whether it holds the information, locate the information, or documents containing it, retrieving the information, or document containing it and extracting the information from a document containing it. The cost would exceed the £450 limit afforded to Cafcass and therefore there is no requirement for Cafcass to undertake the work.

I state...There is other information with regards contact numbers etc. If you had recorded such information in the first place the cost would have been pennies not over £450 as you state.

6. I asked ....How many contact/shared residency/residency orders have been made in favour of men between April 2008 and April 2012?

You replied ...Please refer to the response to question 11 above. My point 4 of this document.

I state ... CAFCASS hide behind any act/policy/law to avoid equality in the interest of justice and children.

7. I asked ...How many contact/shared residency orders have been made in favour of women between April 2008 and April 2012?

You replied ...Please refer to the response to question 11 above. My point 4 of this document.

I state ... CAFCASS hide behind any act/policy/law to avoid equality in the interest of justice and children.

8. Do you have a Equality policy as defined in the Equality Act?

You replied ...Please find attached the interim Equality & Diversity policy.

I state .. you cannot monitor equality and diversity or correct your failings without recording vital information in the interest of children and parents.

9. I asked..How many disabled parents have been discriminated against?

You replied...Cafcass does not collect this information.

I state...you cannot monitor equality and diversity or correct your failings without recording vital information in the interest of children and parents.

10. I asked...Do your case Officers have the same if not better qualifications than a Social Worker
Specialising in Children?

You wrote ...Cafcass practitioners hold a Diploma in Social Work (or GSCC recognised equivalent) and a minimum of three years post qualifying experience in social work with children and families at risk.

I state... CAFCASS practioners are none of the above, they stated so during interview, their work is beyond shoddy. Failure to be tape recorded, misquotes, in favour of the mother. I was interviewed for 2 hours, their notes were no more than 5 sentances all wrong. Yet CAFCASS admit these gross errors and negligence, not in the best interest of the children or parents or justice. Another untrue statement.

Who are you to question a parents rights in light of a parental responsibility order agreed between both parents and supported by a court order. Family Court Welfare Service, now CAFCASS, same dreadful people with another TAG. This how the nation sees you !!!

Therefore, I seek a full review of this matter and an apologhy from your CEO.

Yours faithfully,

John Paffvett

This request raises serious issues in respect of the failures by CAFCASS to record data which many of us would regard as vital in upholding public, never mind professional, confidence in the work it carries out.

Just as it does not collate the information from 'Exit' interviews - despite clearly leading the House of Commons Select Committee (in my opinion) to believe that it does, and stating, without defining. the numbers of children & young people it 'works' with so, here, we discover that it can not provide any reasonable breakdown in respect of Orders made - and to whom, nor in relation to the vital issue of disability.

Disgraceful of a Public Body directly goverened by and accountable to Government.

Thank you for your positive and well founded annotion.

Like the DWP, District Councils, LSC and Cafcass do nothing but deceive, delay, deny and darn lie. I recorded them at meeting, then lied via email, heads of department too. Anyway, Court Welfare, now Cafcass; same dreadful people different name. Their own boss stated starting point 50/50 unless independent risk to child. God help you if you are disabled and male, you have no chance !!!

Dear Governance - Cafcass,

I cannot believe you do not hold and record such vital evidence, I cannot believe you hide behind information avoidance using a FOI request, I can personally say that this request would not by any stretch of the imagination cost the upper of or more than the cost of a FOI request.

2008 Ofsted called your organisation amongst other things "Dangerous to our children" Late 2011 government committee stated "CAFCASS is beyond reform, it should be abolished" Another government office states "Bias towards men".

I have always said, the court welfare office are the most dreadful people, same people new name. CAFCASS are the worst organization for being the "Eyes and Ears of the Court".

Welcome to broken Britain.
