C-456/12 CJEU

Daniel made this Freedom of Information request to Home Office

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was partially successful.

Dear Home Office,

I kindly request any information provided electronically (via internal communications) that relate to the O&B (C-456/12) determination held by the Home Office.

Further:-

1. Can you confirm if case workers examining applications for EEA Family Permits have been given any information with regards C-456/12? - I am particularly interested in any electronically communicated information.

2. Should a British Citizen who is exercising his/her treaty rights in accordance with the guidelines laid out in C-456/12 (Binding on the UK), then decide to return to the UK, can you confirm that the O&B judgement would facilitate entry to the UK despite the current (and unnecessary) "Centre of Life" test.

So as to avoid any cost issues, please limit any searches to Electronically held means, I.e. internal intranet, emails etc

Yours faithfully,

Daniel
