I am writing to request an internal review of Children and Family Court Advisory Support Service's handling of my FOI request '[email address]'.

1) You have not replied to the question when cafcass who would on occasions contact other agencies in other areas when carrying out checks for court orders, what email address has cafcass got on there system as you contacted Southend Children services in 2012 and 2013 by email, would cafcass hold for southend on sea borough council?

2) When contacting Southend Children services in 2012 and 2013 and sending letters to email accounts what address does cafcass hold for southend on sea borough council children services? you are saying you do hold this data but in letters i have at hand it is clear you do hold such data as you sent to by email and have an address on the letter, i request to see if the data you hold is correct, as the court was told checks had been carried out to the above and on my own checks to southend they have no record of any such checks ever being made as the court was told was the case by said named cafcass officers Ms Jenny Walton from the west midlands region in her safeguarding check and as did Mr Sean McCann of cafcass. this request is in the public interest now we add.

3)[email address] Are cafcass stating as this not clear that this email address was provided to member of the public who were using your services from April 2012 until December 2012? why was this in use for 6 months only? please provide proof by way of headed paper this was in use and show me in what location this can be found on cafcass operating frame work policy ? so cafcass early intervention team area 5 would be under what area now? what region does this apply to and did so in 2012?

4) so .C5EIT Was part of area 5 email address then in 2012 is this what you are saying as this is not clear?

Dear Mr Davis

Thank you for your email of 20 October 2016 in which you requested an internal review of the Freedom of Information response dated 23rd September 2016. You state that Cafcass has not replied to the question and then repeat an assertion that Cafcass have alternative addresses for Southend Children Services. It is not the function of an internal review of a Freedom of Information request to provide addresses for third party organisations or to investigate complaints about individual case work.

Melanie Carew, Head of Legal, has reviewed the initial response to your request and has upheld the original response.

Responses to the specific requests are refused under Section 14 of the Freedom of Information Act 2000. This exemption exists to protect public authorities’ resources from unreasonable requests and disproportionate use of the Freedom of Information Act.

Section 14 Vexatious or repeated requests.
(2) Section 1(1) does not oblige a public authority to comply with a request for information if the request is vexatious.

Your requests are considered to be vexatious, as we believe that a response would cause an unjustified level of disruption to Cafcass. This decision is based on the perceived lack of serious purpose and value of the requests, and the fact that they form part of a series of frequent requests which has contributed to an aggregated burden on Cafcass. Cafcass is permitted to take into account the context and history of the relationship between Cafcass and yourself. Your repeated and numerous requests cause a strain on the resources of Cafcass, and a number of your requests repeat queries which have already been addressed. As these have previously been responded to, these further requests appear to lack serious purpose to obtain information. Providing responses to these requests imposes a disproportionate burden on Cafcass and wastes its time and resources, which is an abuse of the right of access to information.

If you are dissatisfied with the way the internal review is handled or with the final decision made at that review about the information released, you are free to contact the Information Commissioner’s office which can be contacted at [email address]
