Re: Your request for information 
 
I am writing with reference to your email of March 9th 2010, in which you make the following request for 
information:  
 
Regarding the Busway contract and the report to Cabinet (agenda item no.9 dated 16th March 2010). 
      
Please provide a list of the Compensation Events notified by the Council to BNL, or vice versa, along 
with for each event: 

•  The change to the Target Price 
•  Whether the Compensation Event has been accepted by the other party or is disputed 
 
This request is being dealt with in line with the Environmental Information Regulations and I can 
confirm that we do hold the information.  
 
Please find attached a spreadsheet showing: 
a.  Compensation events which have been agreed or assessed by the Project Manager and the 
corresponding change in target price as a result. 
b.  Compensation events which have yet to be agreed. This includes compensation events issued by 
Atkins on which the value has yet to be agreed or assessed and compensation event notifications 
received from BAM Nuttall that are disputed.  (Please note that in the case of an event which has 
yet to be agreed, there is no corresponding change to the target price.) 
 
If you are unhappy with the service you have received in relation to your request and wish to make a 
complaint or request a review of our decision, you should write to Nicola Graves, Customer Service 
Manager, c/o Information Governance Team, Box RES 1405, Shire Hall, Cambridge CB3 0AP within 
40 days of the date of this letter.  
 
If you are not content with the outcome of your complaint, you may apply directly to the Information 
Commissioner for a decision. Generally, the ICO cannot make a decision unless you have exhausted 
the complaints procedure provided by the Council. The Information Commissioner can be contacted at:
