Thank you for your email where you have requested information regarding
how much LCC are being paid for use of Preston bus station as a film
location for the film 'Ip Man'. We apologise for the length of time it is
taking to fully respond to your request.

 

We are still in the process of dealing with your request, and we have been
advised by the relevant team (legal services) that we would need to seek
the film company's views  on disclosure of the above information. We have
made contact with the film company in line with the section 45 code of
practice – 'IV Consultation with Third Parties', in order to obtain their
views on disclosure.

 

The commercial interests exemption at section 43(2) of the FOI Act states
that information will be exempt if its disclosure would, or would likely
to, prejudice the commercial interest of any person; subject to a public
interest test. Upon receiving your request it has become clear that the
information required could potentially be claimed as being 'commercially
sensitive' and as such we have had to seek the views of the production
company on disclosure.

 

In considering the public interest arguments, we accept there is a general
interest in the disclosure of such information to ensure there is
transparency and accountability of public funds. We also acknowledge that
there is an interest that the Council's commercial activities are
conducted in an open and honest way. However, these interests have to be
balanced against any potential prejudice of the commercial interests of
both the council and third parties.

 

As mentioned above, we have contacted the production company but have yet
to receive a response. Without the film company's views we are unable to
provide you with the information you require.

 

We are sorry for the length of time it is taking to deal with your
enquiry. As soon as we are in a position to respond further, we will do so
immediately.
