With regard to your Freedom of Information request received on 30
September 2015, please find our response attached and below.

We must inform you that some of the information you have requested will
not be supplied.  In accordance with the exemption at Section 12 of the
Act a public authority is not required to comply with an information
request where the appropriate time/cost limit would be exceeded. 

 

Business Rates have identified that the liability start date is not
provided as part of their current reports and that it would require a
manual search through every account to identify, extract and collate this
information.  Based on absolute minimum of one minute per account this
equates to over 147 Hours. 

 

Whilst this is a strict interpretation of the Act, the Council policy is
to provide a balance between the needs of the requester and the use of
resources to ensure effective service provision is maintained.  We
therefore provide the following responses to your questions.

 

In accordance with Section 17 of the Freedom of Information Act, the
Council is required to inform you that some of the information on the
attached document has not been provided and has been withheld due to the
following exemption under the Act.

 

Section 40 - Personal Information

It is considered that this exemption under Section 40(2) (b) of the Act
applies, namely that the rate payers of non Public Limited companies and
Limited companies is personal information and disclosure would breach the
rights of the individuals under the Data Protection Act.  The Council
cannot disclose personal information where to do so would breach any of
the data protection principles.  In this case it has not proved practical
to ask the data subjects for their consent to disclose the information
about them.

 

 

Although information supplied in response to your request may be in a
Microsoft Excel format please feel free to contact us should you wish the
information to be supplied in an alternative more readable/reusable
format.
