Business Rates - April
Dear Derby City Council,
REQUEST FOR INFORMATION UNDER THE FREEDOM OF INFORMATION ACT 2000.
In accordance with the provisions specified within the above Act I hereby request the following information.
All information requested relates to Business Rates.
This request for information falls within the parameters of the Act but if you require clarification on any of the points above or should you wish to discuss this further then please do not hesitate to contact me.
Required Information;- A list of all live business rates accounts with a 2017 list Rateable Value.
• Property Reference Number (also known as Billing Authority Reference Number) of the property on which the charge is made. Please note that this is not the Rate Demand or Rate Account Number.
• Current rateable value
• Account holder name
• Property address
• The billing address (where different to the property address), the contact telephone number and email address
• The date the current ratepayer became liable for the business rates – we do not require any historical account liability dates only the current ratepayers liability start date
• whether a property is empty or occupied
• Where a property is currently empty please provide the date the ratepayer became liable for empty rates
• Where there is an exemption on the account please provide the start and end date and type of exemption applied (e.g. listed building)
• Where there is a relief on the account please provide the date it was applied and the type of relief (e.g. Retail Discount)
• We do not require any personal information or sole traders.
Please provide the information in an electronic, spreadsheet format ideally excel. The Act requires that a response be provided within a period of 20 working days from the date hereof.

I acknowledge your request for information received on 08/04/2020 about
all live business rates accounts with a 2017 list Rateable Value.
Your request is being considered and you will receive the information
requested as soon as possible, but in any case by 11/05/2020 the statutory
timescale of 20 working days as defined by the Freedom of Information Act
2000 (FOI) unless the information requested is subject to a statutory
exemption on disclosure or the information contains reference to a third
party.
If your request does not include all the information we need or is not
clear, we will contact you for more information (clarification). In these
circumstances, the 20 working response deadline will start the next
working day after we receive your clarification response.
For your information, the Act defines a number of exemptions, which may
prevent release of the information you have requested. Some exemptions are
subject to a public interest test. There will be an assessment and if any
of the exemption categories apply and any relevant public interest test is
weighed in favour of withholding the information it will not be released.
You will be informed if this is the case, including your rights of appeal.
If the information you request contains reference to a third party then
they may need to be consulted before a decision is taken on whether the
information can be released to you. You will be informed if this is the
case.
There may be a fee payable for supplying the information in the form of
disbursements. This will be calculated and you will be informed if a fee
is payable. The fee must be paid before the information is released and
the 20 working day time limit for responses is suspended until payment is
made. You will have 3 calendar months to submit your payment.

Thank you for your request received 08/04/20 under the Freedom of
Information Act 2000 for information on Business Rates.
The 20 working day deadline to send you the response was by 11/05/20.
Unfortunately, it is taking the Council longer than expected to deal with
your request because of the workload of the department responsible for
providing the information and also the current COVID – 19 national
situation.
The safety and well-being of individuals is the Council’s utmost priority
at this time. Statutory deadlines may not be met due to the demand placed
on services in dealing with the current pandemic. Further guidance can be

Dear Richard,
The Council confirms it holds information that falls within the
description of your request. We have attached part of the information and
in accordance with the Freedom of Information Act 2000 this email is a
part Refusal Notice.
Section 12: Exceeds appropriate limit
This exemption applies to ‘Sole Traders ‘ because the Council’s Business
Rate system does not identify ‘sole traders’. It would take 542 hours to
carry out a manual exercise to search / identify / extract sole trader
information from over 7200 records which would exceed the 18 hours £450
appropriate limit specified in regulations. This represents the estimated
cost of one person spending 2½ working days in determining whether the
Council hold the information, and locating, retrieving and extracting the
information.
Section 40(2) Personal data third party
Under section 40(2) by virtue of section 40(3A) (a), personal data of a
third party can be withheld if it would breach any of the data protection
principles to disclose it.
This applies to the ratepayer’s name and correspondence address where the
ratepayer is an individual (sole trader, partnership etc) because it would
identify them. It also applies to individuals not participating in any
commercial activity and therefore cannot be classified as; a company, sole
trader, partner or private landlord.
Disclosing this personal data would contravene the GDPR principle 5(1)(a)
which requires ‘personal data shall be processed lawfully, fairly and in a
transparent manner in relation to the data subject’. The
Council believes it would not be lawful or fair to disclose the
information because the individuals concerned would have a reasonable
expectation that personal information about them would not be disclosed
into the public domain.
For your information this request has cost the Council £31.25 to process.
