Please can you provide me with the following information under the
Freedom Of Information Act 2000:-

The most up to date list you can obtain (Ideally from April 2016) (please provide the date of the data) with;
(a) List all Commercial properties with their Rateable Values and addresses.
(b) The names and addresses of the Rate payers referred to above
for each property and their correspondence address (if different
from the property address)
(c) The full billing authority reference for each property (this is the property reference not the account number)
(d) The current liability payable for the year 2015/16 & 2016/17
(e) The date the rateable occupier first became liable for the
business rates
(f) If the property is empty that date it became empty
(g) Please also state which hereditament is currently receiving
I. Charitable rate relief (mandatory rate relief)
II. Discretionary rate relief
III. Empty property rate relief
IV. Listed building exemption
V. Retail Relief
VI Small Business Rate Relief
VII. Any other relief
(h) List of all credits on account and the amounts

In accordance with the ICO Torbay decision, I would appreciate it of this Council did not withhold the names of sole traders and partners. In the circumstances of the Torbay case the individuals were private landlords or sole traders and the Commissioner concluded that disclosure of their names would not breach the first data protection principle as the information relates to the business activities of the individuals concerned and not activities they undertake simply or solely in their private lives. The Commissioner concluded that disclosure would be fair and meet schedule 2 condition 6 of the Data Protection Act.

apologies for the delay in responding. 

 

I have prepared the data for you, which is contained in the attached
spreadsheet, but have omitted information in respect of individuals and
their properties.  The Council does not consider it appropriate to include
the details of sole traders since this information may be considered to be
their personal data and so subject to data protection.  If you still
require this information please come back to us and we will issue you with
a Refusal Notice that will outline all our arguments.  Please note that
credit balance information is not available as part of the report from
which this data is generated.  If you require a list of non-domestic
accounts currently in credit, please make a separate FOI request
accordingly, stating which items of data you would like for those
accounts.

Dear Newman, Martin (LGS),

Thank you for your response, please in addition as requested make a note of h) List of all credits on account and the amounts.

Many councils within the excel spread sheet will list the occupiers, their BA ref and addresses. They will then add a column entry for any credit on account. If there is no credit the cell is blank.

An additional request has not proved necessary for any other council whom has received this request.

Thank you for your reply, It does not have to be a current live account. Many council have credits on closed accounts, I am just requesting the up to date list.

So any closed or live (which you have said do not have any credits) accounts in credit with the BA ref and property address the date they were opened or closed.

Thank you for your email. Yes, the few accounts that are in credit at Swindon at present are on closed accounts, which is why I mentioned previously that credit balance information was not available as part of the report that generates the data for the list of current properties that you'd asked for. I will lodge your latest email as a fresh FOI request for a complete list of credits and request that the appropriate report is run to generate the information.
