This is an update to my previous FOI request made a couple of years ago:

Please indicate for each of your school bus services whether it had any pupil or pupils on for whom they or their family had contributed towards the cost of their transport. By this I mean:

"Discretionary transport

"In some cases assistance may be provided for ineligible children if there are spare seats available on existing school buses however, parents will be expected to pay a contribution towards costs."

Paid Transport Permits

Post 16 Transport Assistance

Or any other system by which a contribution towards the transport cost of any specific pupil on that bus is paid.

The reason I am asking this is that the presence or otherwise of any individual passenger for whom a contribution towards transport costs has been made is a key determinant as to whether the service is subject to the PSVAR.

Please also indicate the name of the company contracted to operate each service.

Finally, please state how you monitor and enforce the provisions of your contracts with bus companies obliging said companies to ensure the vehicles comply with PSVAR.

I ask this as I have clear evidence that one or more of your suppliers are using non-PSVAR Schedule 1 compliant coaches on your school services in circumstances where Schedule 1 of PSVAR is applicable, and I don't think you've noticed or taken any enforcement action. Have you?

Dear Mr Paulley,

 

I am writing further to your freedom of Information request N4789. Please
find attached the information you have requested which is correct at 28^th
January 2019.

 

The Council undertakes regular compliance visits to operators premises to
check out vehicles, paperwork and processes to ensure that the operator
complies with the terms and conditions of contract.

 

The following is an extract from our current terms and conditions of
contract which relates to vehicles

 

 2.7            Vehicles

2.7.1            The Supplier shall ensure that Vehicles shall comply with
all relevant requirements of law relating to construction (including the
Equality Act 2010 and the Public Service Vehicle Accessibility Regulations
2000), equipment and use and shall ensure that the Vehicles are properly
taxed, tested, licensed and insured, and where a Vehicle does not meet any
element of these requirements then this would be considered a material
breach of Agreement under clause 12.2.

If you have a concern about an individual operator or service, we would of
course look into your concern on a confidential basis should you wish to
share that information with us.
