Request for information under the Freedom of Information Act 2000

Thank you for your emails received in this office on 11^th March 2022
requesting information on bus services and stops in Bolton.

In cases where an authority receives 2 or more requests for same or
similar information it may, under the Section 5 (2) of the Freedom of
Information and Data protection (Appropriate limit and Fees) Regulations
2004 (the “Fees Regulations”), aggregate the request for the purpose of
determining cost of compliance.

 

The Fees Regulations state that two or more requests to one public
authority can be aggregated for the purposes of calculating costs if they
are:

 

• by one person, or by different persons who appear to the public
authority to be acting in concert or in pursuance of a campaign;

• for the same or similar information; and

• the subsequent request is received by the public authority within 60
working days of the previous request.

 

The intention of this provision is to prevent individuals or organisations
evading the appropriate limit by dividing a request into smaller parts. In
line with the Fees Regulations the council will therefore aggregate your
requests for the purpose of determining the cost of compliance.

Under section 1(1) of the Freedom of Information Act 2000, any person
making a request for information to a public authority is entitled to be
informed in writing by the public authority whether it holds information
of the description specified in the request, and if that is the case, to
have that information communicated to them.

In this case the council does not hold a record of the information that
you require as bus services and stops are not the responsibility Bolton
Council.

In accordance with Section 16(1) of the Act, the council has a duty to
provide advice and assistance to you, so far as it is reasonable to do so.
